Pretty significant damage to the back of my car. I was hit twice, so my trunk is pretty much done-zo.

They won't let me get started on repairs or a rental until they can hash out the liability between the two cars. Unfortunately I can't drive my car to work (it's drivable for short in-town distances but not to drive on the highway for 50 miles to work), so I'm stuck right now.
Isn't being rear ended automatically the other persons fault?
That's what I thought too, unless the rear ended person was otherwise breaking the law by not carrying insurance, driving with a revoked license, etc.
I work for an insurance company. And yes, 9 times out of 10 a rear ending is usually the person who did the rear ending's fault. However, there are some circumstances that it goes the other way. The insurance company will not make any decision until they've looked at all the facts and taken statements from both parties, just to be sure it isn't one of those rare circumstances where the person who got rear ended is the one at fault. Both companies are going to go to bat for their customers, no company will ever just automatically say their customer was at fault. So @imalwaysme79 's insurance company has to get the other person's insurance to concede liability before they can make a move.
The thing is I was hit from behind once (we'll call him car #2), then car #2 was hit by another car (we'll call him car #1) causing me to be hit a second time. Car #2's insurance needs to speak with car #1 so that they can determine who has what percentage of the liability. I'm in no way at fault, they just need to figure out their end. They won't authorize any repairs or rental until the liability is established between car #1 and car #2.
ETA: I'm trying not to get my own insurance company involved because I can't afford the out of pocket expenses that would come with that right now. Yes, I'll get reimbursed, but the initial outlay is the problem.
@imalwaysme79 I think you're doing the exact right thing in that situation. You don't want to put that claim on your record if you don't have to, even though it' not your fault. I was in a situation like that a few years ago and luckily cars 1 & 2 were able to work things out pretty quickly and get me taken care of, I hope things move quickly for you as well!
@scifichick09 - thank you, I hope so too. I had to miss work today and I 100% can't miss anymore. If there's no resolution by the end of the day today, I will have no choice but to go through my own insurance company.
Guys... I don't know if you remember I was complaining a few weeks ago about my job, and how they didn't give me the promotion I deserved.
My manager calls me into a room today out of the blue to tell me they gave me the promotion AND a raise! I was completely shocked, but now it's sunk in and I'm so excited!
@Aussie45 Thank you! I'm so excited! It was so out of the blue, but she said they think I deserve it, so they reconsidered. I am still a little floored that they went back and changed the decision.

@WinchesterGirl, congrats on the promotion/raise!! Sounds like you more than deserved it and it's about damn time someone recognized that. I meant to say to you I hope you're doing okay with everything you've been dealing with this past month. I'm especially glad and happy to hear that something this positive has happened for you during such a rough time for you. Congrats again!
I will say, @FishyMom, that while threenager can be really trying, they will come back and just be the sweetest little things ever. Tonight she loaded up her little tea tray with plastic cupcakes and presented it to me saying "everything you ever wanted Mommy! You're the best!"
@GingerSnap, mine will say to me when I tell her no or when she's mad at me for something: "I'm not your mother anymore and I'm going to live with a new family now." I have to turn away as I shake with laughter. Yup, you go pack those bags DD, go for it. She also likes to tell me that I'm ungrateful. That's her new word lol I love that pink canopy princess bed btw
