This stinks! That doesn't seem right that you have to break it up. 1st off you're giving birth and should get more time and secondly you should be treated as 2 individuals when it comes to fmla. Not a couple. I've never heard of this.
This makes absolutely not sense at all. And I would look into this further.
DH only gets whatever sick time he has saved up. He has 2 weeks and depending on how long I'm in the hospital (c-section) he may just use one week now and save the other if we need it for appts and such and then if he doesn't use it at all he gets paid time and a half for it which would also be helpful since i'll only have about 2.5 weeks of my leave paid for through saved up vacation.
My hubs just started a new job last month with a small company so no fmla. He negotiated getting a week but we're going to be saving that for the week between Xmas and new years so we can travel to see the grandparents, they're in NC and SC and we live in Boston. He'll be able to take about 2 days of pto when she's actually born and that's it.
My hubs owns his own business, but I think he's only planning on taking 3-4 days. He has an office at our house that he may work one or two days a week at for the first weeks after as well.

I didn't make sense to me either. If we worked for different companies it would never fly. My OB was very put off by it as well. I plan to clarify with the union.
Mine has to use his vacation hours. I went in Monday and just got home today. He was hoping to go back to work today as they may be doing a shut down over thanksgiving in which he'd need vacation time for that too. We decided screw it, he is taking this whole week now so I will have him home 3 days now which will be a big help. I'm such an emotional basket case I may need him lol.
My husband gets 10 days. They allowed him to get out of an Army field problem, thankfully, since it was going to be from the 15th-27th. I am happy with whatever the Army gives him!
If you work for the same company & are married you have to share the fmla time. My so and I work for the same company but we're not married yet so we don't have to share time. SO unfair , I know !
No leave but he can use his vacation days. He took off a week when I had DS...he works 4 10's at the moment so now that he's back he's going to take off Mondays here and the to give us 4 day weekends together. It's nice having the Holidays coming up too I miss him terribly when he leaves for work.
