Canadian Bumpies! Let's talk mat leave....

It's almost time for me to go in to my HR department and fill out my paperwork.  I know the basics; 55% of your salary for 52 weeks, but I'm looking for the absolutely most advantageous way to go about this.  Any and all knowledge of loopholes is welcome!  The part that I'm really trying to get around (if possible), is the whole not getting any payments for the first 2 weeks thing.  I've been saving up my vacation time to tack onto the beginning of my mat leave and I'm wondering if it's possible to take 2 weeks vacation in conjunction with the first 2 weeks of mat leave, so that you are not going without any income for the first 2 weeks.  I'm obviously going to go over all of this with my benefits co-ordinator, but I would sort of like to know what I'm talking about before I go in there.

  • From what I've heard, even if you save up vacation time, you will still have to wait two full weeks AFTER to start getting mat leave from the government. I was at a baby show a while back, and a rep from the government office was there to discuss mat leave and child tax benefits. She stated that many women do the vacation thing in order to not have to go two weeks without pay, but the government will not accept that, and they will make you wait those extra weeks.

  • No- you can not get paid during your two week break, if you do it gets pushed another two weeks. You can ask to get paid out upfront before delivery for your vacation and then put the money away. Any money that you receive after you file for EI must be reported and can delay the TWW or affect the amount you get. My GF tried to cheat the EI while she was on mat leave and when they reassessed her at tax time she wound up having to pay back plus she's now being charged for defrauding the government (it will probably get dropped, but she does have to pay the legal fees to deal with it). Don't mess around with EI!

    Also, you know it's 55% of your salary for the first $44,200- you can't go above that. Also, you generally don't get your first check right on time, mine was delayed by backlog and we didn't receive it until the second pay period when we got a double check.

  • Yeah it's a pita. The first time around I didn't get my ROE to them quickly enough so I waited for 6 weeks before I had any kind of payment. I'm taking vacation from Jan 22 to Feb 13 until I start mat leave on the 14. But Since my techincal last day is feb 11 I can go in then to get all my paperwork done and started. Also see if your company can email/fax your ROE straight to Service canada, this way you won't be delayed more by waiting for it in the mail, etc.

  • If you don't want to waste your Mat leave before you are due you can get a note from your doctor to go off on sick leave. Most of my friends got a note that said that they couldn't work anymore because of sitting or standing too long and so they didn't waste any Mat leave or any vacation and got a couple extra weeks off.

    Thanks!  For some idiotic reason, I never even thought about getting my vacation time paid out instead of taking the days.  That's exactly why I posted here!  Also, I am aware of the salary cap, unfortunately (or fortunately, depending on how you look at it), I don't have to worry about that small detail...

  • You will be waiting longer then two weeks to receive your first payment. My ROE was sent in right away and I applied and it still took 7 weeks till I received a payment. So starting saving some extra money if you think money will be tight.  Really they make effort to give your first payment in 28 days. For my first mat leave it took 32 days. So I've never even had payment within the timeline they state.

    I second who ever suggested sick leave. You can get upto 15 weeks sick leave on top of your 15 weeks maternity and 25 parental. Plus those 15 weeks sick leave can be taken in a combination of before you have the baby and the remaining weeks can be taken after your parental benefits expire if for some reason you are not ready to return to work.

  • It takes a min. of four weeks to get paid from the government.
