Came home from a great evening with family, very tired and ready for bed... opened the back door to let our dog in. In bounds the neighbor's huge, unruly dog who is covered in mud. He dug under thef ence, into our yard, ran through our entire house like a wild freaking wolf, got mud all over the carpets, jumped into bed where my husband was just laying down. Went next door to tell the neighbors (this has happened before, btw). I said, "Come get your dog, he tracked mud all over my *** carpet and he won't get out of my house!"
She never came to get him. I pushed him out the front door finally. Husband went over there after to tell them they wouldb e paying for the carpet cleaning. The woman slammed the door in his face....

Im late jumping in, but if you could, you should snap a few pictures to document the damage. I had the neighbors dog do that in my last house, but it wasn't covered in mud, just irritating that it came in like it lived there. I tried to take it back over to her, but it ran away at her door and she was pissed at me about her dog running around free.
yeah well... keep your dog in your own damned yard.
I'd call the police. It's called property damage, is it not? Oooohhh, that made me mad just to read.

Just be careful and remember that it's not the dog's fault, but the owner's fault for being irresponsible. ?
But I would absolutely take pictures and threaten to sue them if they don't pay for the carpets to be cleaned. If they say no, then you need to sue them for damages.?
Unfortunately I did call the cops and they told me that unless I was having a FIGHT...an active fight (And that didn't happen because they are wussies and just slammed the door in our face), they can't come out.
Also, called the SPCA and because it was after-hours, they would only come out if there was a sick/injured or vicious dog.
So, about my only option is small claims court, it seems.
This happened to my parents a few times. I know it sounds harsh but my dad called the animal control and the police and told them that there was a rabbid dog in his backyard and that if they did not come now that he would have no choice but to shoot it because it was endangering his family. Ofcourse he woud never shoot it but the neighbors would not come get their dog and it was a big mean dog who terrorized us to the point that we couldn't even go outside. The police showed up with animal control within 10 minutes and as soon as the neighbors saw that they came over to finally get their dog. The police told them that it is a felony to have their dog unleashed and that they were responsible for any damage done. They reinforced their fence the next weekend and the dog never returned!
I completely agree that you should take photos and file a claim. You can usually have a lawyer draft a letter and that alone is almost always enough to motivate someone to cough up for repairs/cleaning in this type of situation.
I'm not sure what calling the police would accomplish and calling animal control seems a little bit harsh. Her reaction was completely wrong, but had she been a "normal" person, she would probably have really appreciated having the dog back at the house. You had no way of knowing she would be so rude about it. I would never call animal control if I knew where the dog lived. It's a waste of city services and space for animals that are actually lost.
