FMLA while both parents working @ same company

Forgive my ignorance, but I didn't know that if the parents work for the same company they only get a combined 12 weeks off for the birth of a child.

WTF law! Suckfest!

 

Obvy H and I work for the same company and we're just applying for FMLA now. Without realizing to ask, "what happens when we work for the same company?" I just assumed (go figure) that we were entitled to our own coverage, not combined.

  • I had no idea! My DH & I work for the same company, but only I am using the FMLA for my STD. Our company also offers a parental leave program that he will be using. Luckily we don't have to both use it.

    I read that when I was reading up on FMLA and our company calls it out because there are a lot of couples here.  It totally sucks though!

    I think the reason the law is that way, is that FMLA applies 12 weeks to the child, and therefore you can't double-dip on the same situation.  But since it's impossible to track if you work at different companies, you only get screwed if you work at the same place.

     That totally sucks! Sorry you have to go through that!

  • I read into the FMLA at my work a lot.  If both parents work at the same company, they get 12 combined weeks to break up however they choose.  Sorry. :-/  As long as a company has to honor FMLA, the father can take leave just like the mother.

    and this is where I envy you. Some of my family and friends work for a company where both parents get 12 weeks paid leave. Its not the end of the world that I don't. I have better than some but still sucks when I thought one thing and reality is just setting in. Oh hum.

  • I didn't read it in too much detail b/c it didn't matter to us but I did receive some sort of form in my insurance/LOA paperwork that I would have to fill out if H and I worked together.  It seemed you could only take the 12 weeks combined from the same company.
