CS question

My ex is a "trust fund" baby and doesn't have a job. His child support payments were figured out from the monthly income he receives from his trust fund. However, he wants to move to his home state of Ca. If he gets a job there will my child support automatically change to affect his increase of income? We don't have any future court dates. It was finalized. He will never tell me that he got a job cause he doesn't want to pay more CS. Any thoughts??

  • My still H is a trust fund baby too but he also has a job. We haven't been to court yet as we only officially split up a couple weeks ago. We have two children together.
    My lawyer said his paycheck AND his trust fund come in to play with the child support. But I dont think your EX's job will automatically come in to play. Does he never see his children? I hate to say it but maybe you can find out from what they say if he gets a job. Like asking what did you do at daddys all day,etc. Dont bring them in to it at all obviously but you  know how kids just chatter.

    You would have to go to court to adjust the child support arrangement I am pretty sure.

  • Total net income from ALL resources. If He gets a job, you can request a review of income, as it's a significant change in financial status. I think here it has to be an increase/decrease in income of 20%.
  • I understand that. He will never tell me if he gets a job cause he doesn't want to pay. Isn't there a new hire law that employers have to report new hires so they don't get away with not paying?? I will never know if he gets a job or not let alone the information of where he works. I was asking if he gets a job will child support automatically adjust the child support??

  • They won't adjust it. New hired do have to be reported. My AG send out a letter to the employer and me stating how much he is required to pay. I'd keep calling the AG to see if one has been reported, then file for a case review when you have confirmation.
  • I forgot to add that in my state, CA, any time an employee is hired the company is required to send a form to the state and they use that to garnish the employees wages if they have a reason to. But that would only apply to back child support if he owed it, not to an increase in child support due to a job. So I guess you are going to have to do some detective work to find out if he gets a job.

  • I'm on the SM side but it won't get auto adjusted and you can't just go in and get a redo support amount, you have to wait two years(or whenever your court says) and then take him back unless he chooses to give you more. Thats why sometimes judges will compute a min wage income if someone's not working, they figure the NCP will be working at some point and get caught up on CS. That's also why sometimes bad people will quit their job right before court to keep their CS low.

  • I don't think every state has the "new hire" law!

  • IN doesn't have a new hire law. When my XH finally got a job it was all on him to tell his place of employment that he needs to have CS garnished. How does your X pay CS? If it goes through the state/county I would contact them and ask how IL handles it.
