In most places the test is equal burden on the parents, not whether 1 has "enough". If you're a millionaire you should have to share that largesse with the custodial parent even if they are also a millionaire.
Same for claiming from soneone's will. I fully intend to sue for my share of my dad's estate (who never paid a cent in child support in my life). Yes I'm well enough off, yes I am an adult. That is not the test. I'm entitled to equal treatment with his other children and to me that's the least he could do since he supported them and didn't give me or my mum a dime.
If I had to prove I couldn't get by without his money I'd be screwed. But thankfully that is not the law.?
Re: $40,000 a month in child support
what? Kimora doesn't make enough money on her own? ;P
keep in mind, this is probably about $400/month in normal people terms.
I'll take 2 months worth and be happy!
