Getting laid off...

Got an email from my boss today asking if it would be ok to call me to talk about a few things. I figured he needed some help with figuring out how to do my tasks since they didn't hire anyone to temporarily replace me. He called and informed me that they'd be laying me off. They'll be giving me a severance package (whoop dee freaking do), paying for my health insurance through March, and I can start collecting unemployment now instead of waiting until the end of my maternity leave. I wasn't getting any of my mat leave paid, so by doing this now, I can at least collect right away..that was his way of making me feel better :::eye roll:::

I am a wreck. It's not that I loved my job, but it was a job with a paycheck and I've been there for over 6 years...plus I wasn't expecting this at all. 

I have a document from my boss that I'll be having a lawyer look at so that I don't get screwed over. 

Seriously, who the eff does this to a woman who JUST had a baby? His reasoning for not mentioning it before is that he didn't want to upset me or stress me out while I was pregnant...but hello asshole, now I'm 1000X more stressed because in taking care of a human being instead of just carrying one inside of me! I'm pissed, stressed, crying hysterically thinking about all of the bills we have and wondering how they will get paid....

    That's terrible and doesn't sound particularly legal. I mean, if the company is having problems and there are a bunch of people being laid-off I would sort of get it but this makes no sense. I'm so sorry you are dealing with this. I can empathize because DH lost his job when I was six months pregnant and we are still trying to get back on our feet even though he has since started a new one.

  • That's awful! I am so sorry they are putting you through all this, especially after you said you were doing the job of two people.
    I think you are absolutely right in consulting a lawyer. Unless they have proof or documentation of you doing something incorrectly you may have a case on your hands. In Canada you could probably sue for discrimination - if they do not give you a reason.

    I'm sorry. I wish there was some advice that could help. :( but I hope this works out somehow. Just try not to worry (I know, so not helpful) and focus on your little baby.

  • Your boss needs to grow a pair. Sorry you are going through this! I hope you are able to find a new job sooner rather than later for your peace of mind.  Did you ex-boss offer you a reference? Could he help you find a new job at another company?

  • I'm so sorry this happened especially now and the delivery sucks! My advice is to not sign anything, consult a lawyer immediately, document everything and do not talk to your boss/coworkers about anything. Your attorney will let you know what your options are not only from a severance standpoint. I hope everything works out!

  • So sorry to hear that you're going through this. You should definitely discuss with an attorney, and determine whether or not this can be considered discrimination.

    Take the time to bond w/ baby and use it to your advantage to polish your resume, and find a great opportunity. Perhaps this is a blessing (that you don't see now of course, but will pan out later). Easy to say I know, but I've had setbacks that lead to even better comebacks in life. ;)

  • So sorry about this. It's good that you are talking to a lawyer, hopefully one that specializes in employment laws in your state. If you decide not the take legal action, I would at the very least pursue negotiating for a better severance package and longer term paid health insurance coverage. Leverage that you have been a long term employee and the questionable legality in the timing of your pregnancy with being let go.

  • Sorry to hear that! I'm glad you are having an attorney look it over. Can you go on unemployment after severance runs out? I know it won't be much but it's better to have while you are searching for something better.
  • Ugh, so sorry!  That definitely stinks (my DH was laid off the week before Christmas) so I definitely understand your frustration and stress level.  Sending good throughs/vibes your way.

    Side note: Does your company have enough employees to qualify for FMLA and are you currently out on FMLA leave?  FMLA is job protection - while it doesn't guarantee you can return to your exact position it does hold a place for you in "a similar and like position".
