Who knew having a baby could get you fired

I've been out on FMLA since April 2nd due to hypertension and low fluid and it ended today, so last week, I applied for a personal leave of absence because obviously I wasn't ready to go back to work yet. My baby isn't even three weeks old. I was told I'd hear before today if it was approved or denied. I never heard. So I called HR yesterday and got the voicemail of the person handling my FMLA, saying she's on vacation til the 30th. Seriously?? So I called my boss today and she told me to call the director of HR and of course, I had to leave a message. So this evening, someone finally called me back. It wasn't even her. They told me they denied my leave so I'm done. She said I can reapply for my job when I'm ready to go back (which is the beginning of august.) I'm pretty sure the job will still be posted by then because it takes the hospital FOREVER to hire people. The lady I talked to said the office needs someone now. Bullshit.

  • I don't think they can do that u might want to check what on that for ur state. In NY I know u can take up to 6 months off before they make u come back or lose ur job. That is really messed up. I am sorry u have to deal with this.

  • So messed up. I'm in a similar boat but have better protection here (CA). My FMLA has been used up since I was put on disability early on in pregnancy. Once FMLA runs out I would have had to return or forfeit my job as well. In CA though we have 12 weeks protection post birth, so that's what I'm on now.

    I would see what your legal options are...

  • I'm sorry you're in that situation, but you didn't get fired. I was in a similar position- my FMLA expired when my twins were less than a month old and had been home from the NICU for 1.5 and 1 week respectively. It sucked to leave my job but I'd never dream of saying I was fired. FMLA expiring is just not the same thing as being fired.

    This. As an HR professional, what your employer did sounds like it was within their rights under the Family Medical Leave Act. Yes, it sucks but it is not illegal. I would recommend exploring unemployment; depending on what state you live in, you may be eligible for some benefits as you look for a new job. Best of luck to you.
