Salary question?

I met with my HR person today about my short-term disability for my maternity leave. I am on salary, and asked, what about sick leave and PTO could I use that for the two weeks I won't have salary and my short-term disability doesn't kick in. Apparently I don't have either? Is this the case with all people on salaries or just my company?

Re: Salary question?

  • This seems like something you should have figured out when you were hired. They don't tend to keep the amount of vacation time a secret...

I know my vacation time. I get 80 hours every year. I don't however, get a number for sick leave or PTO. If I'm sick, I stay home and don't have to turn a "time off" card in.
  • I'm salaried and the accrural of my sick and PTO time is well defined in our handbook as is the usage of such time during maternity leave. I get state disability and short term disability for 2/3 of my pay starting three weeks before my EDD through 6 weeks postpartum (vaginal delivery). I have the option to supplement the rest of my pay with my sick leave until it runs out. After my disability period I can take California's Paid Family Leave for another 6 weeks, that wil give me 55% of my normal pay and I can supplement the difference using my PTO til it runs out. Do you work for a small company? I'm surprised your options aren't well defined.

Are you staying home after the baby comes, I assume not. 80 hours (2 weeks) seems like a lot of time now but what if you get sick later in the year or need to stay home with your baby? How does that work at your company?

Some places are lenient, mine is, with things like that. But other places will make you take that time of unpaid. Or perhaps the FMLA chips in there somewhere.

My work gives us 6 weeks paid and 6 weeks disability. Any other time I take would be unpaid.

  • I'm salary and only have vacation time.  If I'm sick and don't go in, I still get paid.  I guess it's basically on the honor system that people who are salary don't abuse calling in.  As far as when I'm off on maternity, STD doesn't kick in until I have been off 5 days, so I saved 5 vacation days to use so that I will still get paid.

  • I get 6 weeks short term disability for a vaginal delivery, 8 weeks for a CS. The first week of STD is actually from accrued PTO (there's no difference at my company between sick, holiday, or personal time; I have 160 hrs to do with what I will). I get to tack on FMLA at the end of STD until I hit 12 weeks out of the office.

I would imagine a lot of this varies by company, but as PPs have suggested, you may not have "earned" enough time this year to have enough PTO to cover you. I'm lucky in that my company gives me all my PTO upfront at the beginning of the year.

  • Ask your hr person about salary continuation. I have 1 week before my leave kicks in but since I am salary my company will provide me with salary continuation for those 7 days prior to my leave. Once my leave begins they will consider that week part of the 6 that I am paid for.
  • Im salaried. I get 6 weeks STD at 60% of salary, but the first week is unpaid so really just 5 weeks. Any after that is either unpaid or I can supplement with accrued PTO. Max is 12 weeks off as per FMLA.
  • I had planned on taking vacation time, but, at the 11th hour was told that is not possible and i have to take STD instead.  This makes no sense to me, but it outlines the fact that even within the law, different companies can still have different rules about how to fulfill those requirements.

  • Like PPs mentioned, this is something that is very company specific so it's impossible for us to tell you what your company's sick/PTO policies are, and really that's all that matters here.

If you don't get allotted time off outside the 80hrs then you may be SOL. I don't get STD, but I've heard from numerous people it typically takes ~1-2wks of being off before you start getting any pay. So you may have to take the initial time off unpaid.

  • I do have STD insurance, but it doesn't kick in until 30 days after the birth, and it's only 60 percent of my salary. We had a different insurance company when I had my first DS. I emailed my supervisor to see about the PTO/sick leave because my company is usually pretty lienient for those of us on salary. Last time they just paid me my regular salary. I'm unsure this will be the case due to budget cuts...

Is this your first time meeting with HR about this to figure things out? It seems sort of late in the game to be figuring out these logistics.
I've been trying to meet with our HR person for two months, and each time I kept getting put off. After an email a day for a week, she finally found the time to meet with me...
