Child Support - Preparing for court

My daughter is 4, and I applied for child support about 3 months ago (long story why I waited so long...). I got a call from my caseworker yesterday that they sent a letter to my ex informing him that I applied, and giving him the option to ask for a DNA test. He has 2 weeks to reply, so nothing else has happened yet.

I am wondering how child support is handled when I go to court. I am sure it may vary by state, but no one in my personal life has dealt with this, so I don't know who to ask. I am just curious about what to expect.

Any advice for me?

    There are calculators used by every state (it varies by state) to determine CS.  It may take into account the # of overnights taken by each parent, who pays for insurance, daycare, and of course income of both parents.

    If he submits to a DNA test, it can take some time to get results.  Then they have to have a court date to determine child support and paternity, and it will take some time to get it set up through the state if his wages are going to get garnished.

    It's going to be a while, but you've waited 4 years already, so just be patient.

  • I work in a payroll department and enter in child support withholding orders daily and most states are at least 50 percent of his disposable earnings every paycheck he gets. So anything after taxes is subject to 50 percent some states more if he is in arrears and more if he doesnt support another family. The court will send the agreed amount after they calculate earnings of both parents etc and send the order to the most recent employer on record and send that paperwork to the hr dept or whoever manages their payroll. Bc every case is unique it can take a while or it may be much faster. Hang in there u will get the financial support u and ur child deserve soon! Goodluck!
