Also, I put this to you: Vaccines aren't 100% effective. They would not be able to prove that the child would not have died had they received the vaccine.

In theory, yes. In practice, no. While I believe parents who don't get their kids vaccinated are 100% morally liable, legally I'm very uncomfortable with the idea of giving the government so much power to decide what I am required to inject
Instead of making anyone liable after the fact, I would increase the person's insurance premiums, cost shares, co-pays/, and/or deductibles (all or a combination).

I am very pro vax, but I think there are too many factors at play here. PPs have mentioned a bunch of scenarios where I feel it would be difficult to decide whether the death of a child would have been directly related to the decision of the parent.
