Would you turn your job in?

For violations about breaks, lunches, and health safety? 

I get no lunch break, I get no actual breaks.  Also, there is only one little spot to eat in the kitchen (which the boss usually parks his fatass) or there is a chair against the wall.  Also, the kitchen sink is also the steriliaztion sink.  Ick!

WWYD? 

ETA:  I'm not supposed to eat at my desk.  Also, if the phone rings when I am eating, I have to hustle back up front to get the phone no matter what.

    I worked for a small family run retail business a while ago, and there were only 3 of us (not including the boss/owner on the payroll) and the situation sounds similar. I am not much help, I am afraid,  but I am curious as to what others will say.

    Yeah, I think this is going to be your biggest obstacle. 

    Do you have to answer phones all day?  Can the phone be put to voicemail during normal lunch hours?  Or 30 minutes if that's your scheduled lunch break?  Do you have an employee manual?

    LOL!  Um, no.  When I was just temping, I got my breaks & lunches, which I left for.  After I took the job permanently, I got a talking to about taking any break/lunch.  He said that,  "We just don't do that here."

    DUDE.  When you leave report this to whatever authority you need.  This is bad business because if you have hangry employees bad things can happen.

    I have to be available to all patients all day.  Be it phone or in person.  He does NOT like things going to voicemail.  He actually doesn't like the phone to ring more than once, even if I am on another call.  I got reprimanded for that as well because, "I just need to handle thta better."  Jerkazz. 

    I get no scheduled break.  We have no manual. 

    The temp agency actually asked me if I was really really sure I wanted to take this job before I said yes.  He is a notorious bully & jerk, and he has had mare than a dozen temps leave mid-day. 

  • Yes. If I needed the income from the job, I'd do it after I had already secured another job though. There's always the chance they could find some reason to lay you off in retaliation.

    Because since you're pregnant I would tell him that you need to eat at regular times and if he has a problem with that he can kiss your ass.

  • The thing is, I could leave.  However, I'm going to take a year off after bambino so I want $$ in savings. 

    Also, I want a new couch first too.  lol.  We could be fine if I left anytime.  I would just feel more comfortable with more saved, YKWIM? 

  • Labour laws are for the reading wherever you live.  Here (in Ontario) an employer is required to provided 1/2 hour unpaid break after 5 hours have been worked.  This can also be taken in 2 - 15 minute unpaid breaks within the 5 hour period.  There is no provision for other breaks in a regular 8 hour workday.

    About $3000.  So, kinda? 

    Ugh.  I'm too cheap & too responsible.  I feel like I need to stay because it's the most fiscally responsible thing to do for my family.  Although, I f'ucking hate it here.

    The sink I'd definitely report to the medical board or health department.  Healthy safety will get you slapped.

    As for answering the phone at lunch - I'd sweetly let him know that you'll be more than happy to answer the phone during your lunch and breaks as long as he pays you during that time per state law:

    • Workers must be paid during their meal period when:
    • They are required or allowed to remain on duty.

    • They are called back to duty during their meal period even though they normally are not on call during the meal period.

     (of course I'd also check to be sure that state law applied to a small business)

    WOW...this guy sounds like a maniac.  It does sound like you have made up your mind to stick it out.  Just hang in there and take care of yourself.

     

    And I agree with PPs -- that you should report this guy when you leave.  I am sure you wouldn't want anyone else to be treated like you are currently being treated, pregnant or not!

    Well, don't literally f'uck him, but tell him to put his issues where the sun don't shine. 

    You're gestating a human.  Your need to eat trumps his desire to have the phone answered after one ring.

    Also, whoever brought up the kitchen sink being the same as the sanitation area is a massive health violation is spot on.  He could be closed down for that.

  • Oh how I feel for you and know exactly what you are going through. I worked for a jerk off for about 4 years. He was a chiropractor and was cocky, inconsiderate, irrational, selfish and had questionable patient morals. Basically he was a money hungry azz./

    He would not allow us true breaks either and we still had to clock out for 30 mins. a day to sit in the waiting room and get up as soon as the phone rang. He would also send us on personal errands( like taking his dog to the groomer, going to stores for him, going by the bank) while we were clocked out. He would tell patients that he could solve their back problems when he knew that he couldn't and charge them tons of money. He would tell my co worker that she needed to loose weight in order to continue working there because he wanted to present a healthy lifestye appearance. While pregnant (both times) I could not go to my OB appointments during work hours so I had to find a OB that had Friday afternoon hours(which was very difficult). The list goes on and on and on.

    He was a miserable person and took it out on me and my co workers. We all evetually left and I have heard that he has been through almost 10 employees since then and that his practice is going under. Karma is a biatch!!! I couldn't be happier with my current job and hate that I worked for him for so long. I say report that douche and break free and enjoy the last months of yo' pregnant ass. Good luck!!

  • I would report him for several reasons:

    1) He's a jerk face asss

    B) Not following break and lunch regulations can get him in trouble, and get you back pay. At a previous job, I received back pay of a few hundred dollars because the company didn't properly follow the break and lunch laws. They weren't mean about it, they just did it wrong and I got paid for their mistakes.

    Sorry your boss sucks his ballsack so much.

    A couch is not worth your tears (unless your current couch is so bad that it causes even more tears when you sit on it).

    I am no longer a temp GM.  I called the temp agency so that I can leave this crapass job & work for a reasonably crazy dentist.  Wink
  • I would 100% report him.  If not for you, for your fellow employees and the person who will be replacing you.  Make really good notes and if he fires you for it you can sue him for retaliation. 

    I don't really get my breaks around here, but I feel like all the time I spend on the internet makes up for it.  Plus I get an hour for lunch.  I'm sure if I really pressed I could get 2 10 min breaks but I like my sparadic internet time.

  • Have you thought of getting yourself fired for something really stupid and getting unemployment? I say this cuz you can probably get him two fold with this information. If he fights it, then you have him not allowing you lunch and breaks which are required by state law. Which will get him into trouble regardless.

    That way you can get more than the next 6 weeks worth of some sort of pay. Just a thought.

    I get that, it was just a thought though. He would get in boat loads of trouble if he fired you for taking your breaks and lunch sanctioned by law.  Which is why this popped into my head. My old work got into trouble a lot for doing this same thing and would fire people for leaving the phones on their breaks during busy times (call center). Those that were fired ended up fighting them through unemployment and my old job got in a lot of trouble. So much so that all employees that were working during that time were paid for their 30 minute lunches that were never taken.

    Hence why the idea popped into my head. I've been there, it sucks. I ended up quitting that call center and never filed for unemployment. I would still be tirning him in though. He is breaking the law by not allowing you your 2 10-15 minute breaks and 30 minute lunch.
