Interstate Adoption Attorney

It's been years since I posted on here and my goals have definitely changed!  Last time it was about TTC, but now it's about adoption.  A friend of mine in another state called last week and has found herself in a situation where she cannot keep the baby and asked DH and I to adopt it.  She just found out she's pregnant and hasn't even been to the dr yet.  We are holding off on getting an attorney until after she has her appointment, but my question is this....Is it better to get an attorney in my home state or in the state where BM lives?  I've heard it both ways.

  • I am working on a same state adoption with an attorney and he recommends we get an attorney to represent the e-mom as well.  If she was in another state, we would've gotten an attorney in her state to represent her.  Of course our attorney is near us.

  • I think it depends on the state the BM lives in and your state laws for the Intercompact.  I recommend the BM's state since we just had to fire our lawyer for messing stuff up.  Our new lawyer is in the BM state and hopefully things will now go smoothly.  GL.

  • I would get one in both states.  We lucked out as we are finalizing in the same state that B was born so we only have to have one but if we were going to finalize here in AZ we would have had a second lawyer here.
