My divorce hearing was even worse then I thought.....

I had my 1st divorce hearing with a case management person last week.  It was just a hearing.  My divorce lawyer tried to come to an agreement with my STBEXH but it just wasn't happening.  He is in jail and completely dellusional and won't budge on certain factors (like custody and her visiting him in jail).  The divorce will happen eventually, he's just not making it easy. 

The kicker is becuase we can't come to an agreement that our pre-trial hearing has been set for the next available date..............September 2012!!!

    That is so ridiculous. I only know what you've posted on Parenting, but this is not a mentally stable individual. Can't they grant you a divorce and revoke his custody rights just based on the things he did to you? It has to be torture for you to have to wait that long. I'm so sorry.

    I wish!!!  Nope, we have to go through the normal process like everyone else.  He can fight me all he wants, it just drags out the process.  Once we go to court, before a judge, he won't get anything because of the situation.

    That's what kills me, so basically I have to stay married an additional year and delay going back to my maiden name because the courts are backed up.

    This sucks!  My lawyer is going to keep trying to get him to come to an agreement but we shall see.

    I'm sorry R. I wish I could say I'm surprised, but as you know this is the reason it took me three years to get divorced. The legal system is a big, fat fail sometimes. ((Hugs))

    You can legally change your name any time you want.  It might make you happier in the meantime.
