Last name rule.....??

My boyfriend and I are waiting to get married until after the baby is born.

With that said, we just realized that we weren't really sure which last name the baby is supposed to take.

I just assume give the baby his, because we are definitley getting married, but I'm wondering what the most common approach is. Does it matter for birth certificate reasons? Does the baby have to take mine?

  • No the baby doesn't need to take yours. It usually goes to the father's last name, no matter if the parents are married or not. In this case its probably eaiser to name after Dad to make it easier with social security...changing a name is a pain!

    No, your baby can take your husband's last name and if you are planning on taking his last name when you get married, I'd suggest doing that because if the baby takes your last name and you get married & change it, then the baby will have a different last name than you!

  • I kept my name when I got married, so we are still decided how to handle the last name issue. I might give our bean my last name as a middle name ....

    Pretty much.  It's one of the powers of being a parent, the right to make up a name.  You can put "I Don't Have a Last Name" on it and they will let you.  I think there should be laws about that, lol.

  • I always thought, unless the father wasn't in the picture, then the baby takes the fathers name.

  • It is up to you.  If you are going to change your name to your boyfriends after you get married then you might as well give the baby your boyfriend's last name.  If it is possible that you won't end up married and you don't want the baby to have his last name then it is your legal decision to put whatever name you want on the birth certificate.

  • It's entirely up to you.  My husband and I do not share a last name, and will give the kiddo both of our names.  Be aware though that they may tag the baby with your last name in hospital before the birth certificate is filled out, for identification purposes.

  • I'd give your baby your last name. When/if you get married you can change the LO's too.

  • I was unmarried with my DS and will be again with this LO. We were living in Utah. They knew he was the father and would be the father on the birth certificate plus DS was taking his last name.

    They just had him sign off on some paperwork and watch some video detailing that since we were unmarried and there was no DNA evidence that the baby was his -- if he signed as the father on the certificate, the law would see him as financially responsible for the baby.

    After the video and the paperwork, they had no issues with DS having SO's last name. I'm not sure if it's the same in every state or not.

  • Like pp said you can give the baby any last names you want, even made up. But fwiw, I'm unmarried and we will be giving the baby his name. We plan on getting married afterwards.
