Argument lead to....

On Tuesday night husband left and moved in his step mom (wierd i know). He is freaking out of responsibility and we fought and I kicked him out. He hasn't giving me any money this wk for our daughter how long should I wait to get him on child support 2 wks...a month?? I am also 38 wks pregnant yes he is a piece of dirt and will be getting induced next wk for med reasons. Would it be easier to get child support on him once my son is born and fill the application for both children at once? Also if you file for child support do you also have to file for child custody?? I don't intend on paying for the divorce he can do it if he wants it.

    In my state, you have to have a divorce or legal separation filed before you can file for child support. This is because the divorce/legal separation would have parenting time defined, and child support is partially calculated based on how many overnights the non-custodial parent has.

    It can take several months for child support to be ordered, and even then, it's no guarantee he'll pay into it. From this point forward, you need to budget for not seeing a dime from your H.

    And why on earth wouldn't you want to file for divorce? The whole "he can do it if he wants" thing gets a big side-eye from me. You kicked him out and you sound like you don't want to be married to him anymore. File for divorce and get the long process started.

    I don't know where you are from, but I am in PA. Here, whenever you move out, that is a legal separation. You don't file for it through a court or anything. You can file for support from the date of separation. So, say you separate June 1 but you don't file until Sept 1. You can collect from the date of June 1 and he will owe that in back support. If I were you, I'd wait until the baby is born and then file, that way, you don't have to go through two separate domestic hearings for one case.
