"Possession is 9/10ths of the law"

...scared the crap out of me when a lawyer I talked to told me that yesterday. I now know that even IF my ex decides to stop being a major douche lord, and decides he wants to take an active role in this little girl's life (& not walk away because I refuse to give her his last name). I still plan to file for physical custody & get some visitation established on paper. To know that without an order in place if I let her visit with him unsupervised for the day/weekend & he decides he doesn't want to give her back, HE DOESN'T HAVE TO!!! AND he's not even a citizen of this country (he just has a green card) he could take her back to Africa with him if he wanted to and it'd be HELL trying to get her back...if ever. It breaks my heart that the legal system is the route that I have to take but he's so unstable & unpredictable and I have to do whatever it takes to protect both myself & my baby girl.

Nobody i know has ever had to go through anything like this, so sometimes I feel pretty alone. My mom & family are all completely supportive of whatever I choose to do, but still...it's a lonely feeling. Glad there's boards like this....thanks for letting me ramble :)

  • This was my biggest fear and the top reason I began looking into finding a lawyer.  I thought to myself that he would never do this, his family wouldn't let him, it would hurt him in the long run, and such.  Then just a week ago he got mad because I told him that we would have to settle through court since we couldn't even discuss custody without him throwing a fit. He said "what do you think I am just going to take him away from you one day and never bring him back? Well I can't do that so we don't need to go through the court and lawyers bs!"  My mouth dropped as it has passed through his mind so that just gives me chills.  I know how you feel.  Even thought he won't be on the BC I am still going to be the first to file!

  • I had this discussion with a lawyer too, and as long as his name is not on the BC and paternity has not been legally established yet, he cannot take off w/ LO legally.

  • Don't sign a passport application for her.  He can't take her out of the country without one.

  • more specifically i was talking about if his name were on the birth certificate. but it's all null & void now. his name isn't going anywhere NEAR it!
