They are going to fire him

According to dh's boss and hr, he will be fired if he doesn't show up for work Monday morning.  He can't even sit up yet and will probably be discharged from the hospital Sunday.  He's only been at the company 11 months and needs to be there 12 months to get short term disability.  For the past 11 months, he has worked 7 am-at LEAST 10 pm for this company, without overtime or bonuses.  

He holds our health insurance.  

Excuse me why I go cry the rest of the day....

  • I'm no HR guru and I know Texas is an 'at will' state but what is their justification and can they do this?

    Once (if?) he gets fired, I have no problem releasing the name of the very huge company with over 900 stores all over the nation.  Boycott away.

    I think if/when he gets fired you need to hire an attorney or at least go to the media. The media will eat this up.

  • Ugh, this just pisses me off.  Is he out of sick time?  I'm so sorry you have this added stress on top of everything else.  Hopefully he'll be able to at least show up on Monday, they didn't say he had to *do* anything, right?

    When he feels up to it he should start looking for another job even if they don't can him.  I wouldn't want to work for douchelords like that.  :(     

  • I'm so sorry. What jerks! What about FMLA? Do you have to be there a full 12 months to qualify?
  • Be sure that you have written doctor's orders that he is not to return to work for X days/weeks upon discharge. This will help your case.  Get everything in writing.

    Even if he is fired, he might be eligible for unemployment.  At least file and try.  It's not great, but its better than nothing.

    See if his doctors think that his health issues were related to his stressful workplace. If so, get that in writing as well.

    He should still be eligible for COBRA.  I know it's ungodly expensive, but it will cover his followup care.

  • Mrs Rosie--yes.  Headquarters not in Austin.  

    He doesn't qualify for FMLA or short term disability because he hasn't been with the company 12 months.  

    He's going to get out of the Hospital Sat or Sun, check into a hotel and return to work Monday.  He feels like there's nothing else he can do since we need the income.  

    Wish he could find another job....he's been looking for jobs in Austin for the past 18 months.

    Wow. I just don't understand how someone can be so heartless and lacking in compassion (and logic).

    I am so sorry. 

    Now, next question- is there anything that we can do to help you or him? I know he's not in Austin- does he need a service to come in and clean/ do laundry/ prep his liqui-meals? 

    Do YOU need someone to mow/ clean/ prep meals so that you can spend more time checking in on him?

  • People are so F*#$% ridiculous and heartless!!!  I am so, so sorry you are going through this.  I know how you feel, I have been there.  My husband got fired last April from a very big, well known company here in Austin after he was there for 10 FREAKIN years. His boss was a total douchebag and they did not get along and he got my husband out. It was so unfair and we lost our health insurance as well. My husband did file for unemployment and he received unemployment for about 6 months or so.  Now he is with another great company and they are hiring I believe.

  • That seriously sucks.  I think he should go into work, exacerbate his condition and then sue their butts for worker's comp due to not being able to stick to doctor's orders.  There isn't a word that could properly describe his b!tch of a boss and the HR department.
