I was on my way home from work and some guy stopped short in front of me. I rear-ended him.
So, we pulled into the rec center that was right where the accident was. My car pretty much has no damage - only a few scratches. His bumper was cracked and the paint was peeling off.
Immediately he said that he doesn't speak English so he called up a friend to translate. He wouldn't give me any info and didn't want to go through insurance. I called up DH and he told me to call the cops because something weird was going on.
The cop was there for over an hour and finally came to my car and told me they are simply stalling because INS was on the way to pick the guy up!!!
From what I understand, he was legal at one time. There was a hearing and he failed to show up so there was a warrant out for him to get sent back to his country. He was Hispanic but I'm not sure where he was from.

No, not bragging at all. I feel badly for him. I think I was just shocked at how something so minor turned into something that was probably life alterning for him.
Had I known what the outcome was I probably wouldn't have involved cops. Because of the language barrier I couldn't get any information out of him so I wanted to get everything documented just in case.

Not trying to start any "race wars" or anything at all, and in fact, not trying to be snarky at all, but OP said that the guy didn't show up for his hearing and that's why the warrant was issued. That's not really a "technicality" in my book, that seems like a pretty big deal, a hearing about your citizenship that you just don't show up to? And (I don't know if the guy was pissed) but to be pissed that you got deported after that....seems like he sort of was responsible for his own deportation in that sense.
ETA: I do feel bad for the guy that he had to be deported, but I see it as he could've avoided it if he had shown up to the hearing.

Yes it is a technicality if he didn't show up for a hearing. he may not have gotten his mail or he couldn't afford to take off from work. For all you know it was just the oath ceremony.
have you heard of empathy? She may not have caused it but she could feel badly if this guy got sent back because of some scraped paint.

It wasn't his car but it was insured. He wouldn't provide me with any of that information until the police showed up.
INS doesn't exit anymore. The correct term is Immigrations and Customs Enforcement.
It is kind of sad that this guy was just minding his own business and was rear-ended by you (which sucks in general) and now will have to leave his home because of that.
I would feel pretty bad.

well she's not the victim here and as bad as she feels she will be sleeping in her own bed tonight.
Maybe she can contact the police station and see if this guy has a lawyer. She could even speak on his behalf. Feeling bad doesn't change anything
Unless you have dealt with Inmigration you just don't know how they really are unorganize. Some times they send notice sometimes they don't. Some times they send it to the persone with the case number right below yours, and unless that person is nice enough to take time to find you and notify you (like it happened to me) you are just out of luck!
It is sad that for something that minor he gets to get deported. Obviously this guys is not at bad person at all, otherwise he could have just left the scene of the accident like many people do when they know that either they dont have insurance or know that they have some kind of warrant for their arrest, so that lets me to beleve that this guy didnt even know what was going on with is inmigration status.
This - we don't know his story on why he missed, and it's wrong to just assume he missed on purpose.
OP - I'm glad you're okay and it's obviously not your fault that this happened, I just feel bad for the guy as well.

I guess I feel bad for both of them... I would call the cops as well. Due to the fact that his bumper had damage, although minimal it was damaged... She didn't know if he would later call the cops on her any more than she knew his situation... Yes she will be sleeping in her bed tonight while he won't be, but that doesn't make her a bad person. I used to feel like if you're illegal you're illegal and you need to leave, but as I've matured and also through things I've learned here that's not the case anymore. I feel bad for this man. It's a bad situation all around. IDK how immigration works with things like this, but here's hoping it will get worked out.
i think laura belle is right. And many states don't even have the cops come out if the damage is less than a certain monetary
I don't know about other states but I do know that in Florida the driver who hit the other one is not always at fault. If the driver stopped suddenly or cut you off and there was an accident that gets taken into consideration. I was on US1 and a car cut me off causing me to rear end him. I didn't get a ticket. The other driver did.
So sad that he felt he had to be on the run. But perhaps his life situation made being in hiding a better (and safer) option then returning to his home country.
Hopefully they get this resolved for him.
Glad your car is ok because it sounds like he was driving without insurance.
I don't care what colour his skin is. If you aren't legal then don't put yourself in a situation where you can get yourself deported. It's unfortunate but it's his own fault.

Touche' I guess. You're right, perhaps he didn't get his mail. I don't know much about how these things are handled, but I would think a notice would've been sent for the original hearing, and then a notice sent to him that a warrant was being issued...so it's an assumption (and true I shouldn't assume) that there would've been some point in the whole process that he could have at least contacted the court to try to rectify the matter.
And no matter what the "hearing" was (oath ceremony or not), obviously the law feels that by missing this court appearance he has not upheld his responsibility to maintain his citizenship in this country.
And again, I DO feel badly for the guy, but it's one of those "if it's not your responsibility to be at your own citizenship hearing and if it's not your fault, then WHO'S is it?" things.
I work in immigration so I'm telling you from experience that the majority of the time they don't even send out notices. IT is not an organized organization and anyone subject to the red tape knows what I am talking about.
He doesn't have to leave his home because he got rear-ended. He has to leave his home because he didn't show up for court and he had a warrant out....her rear ending him just provided the opportunity for the police to find him, but he is ultimately responsible for missing an important court date in the first place. Regardless of WHY he missed (work related, didn't get his mail, whatever) it is his responsibility to keep up on his citizenship.
in MI (I don't know where OP is from, but I'm in MI) we have "no fault" laws. It doesn't matter who hit who. Basically if there is an accident your insurance pays your damages and mine pays mine regardless of who's at fault.

The guy has to go back to his country. You don't know if he was here for political asylum and if he may be executed when he goes back.
He may be on the run from the gang from el salvador and what does it cost you to have some empathy for a human being who is being banished and sent back to poverty, violence and maybe even death?
I'm in VA. It's not a no fault state.
Even so, not only would he not provide me with his insurance information, but he wouldn't give me anything - name, phone number - nothing! I would have been willing to not go through insurance but I couldn't get any information out of him which would have made any sort of claim impossible.
The officer spoke Spanish. I took 5 years of Spanish but my speaking skills are definitely lacking. I can understand a few words here and there but definitely not enough to carry on a conversation.

well that's probably why he couldn't communicate with you. Your husband thought he was shady but it was actually a language barrier.

I really don't think that the guy knew that there was something wrong with his citizenship. He seemed nice enough and not nervous at all. If he thought he was going to be deported wouldn't he seem just a little nervous?
yes, good point. he has a common enough name and is not in the system yet so I'm crossing my fingers that it was a mistake and he is already at home drinking coffee chatting about his exploits in the pokey
