For those who quit while on maternity leave...

Hi! Sorry, I'm sure that this question has been asked before.  

I'm scheduled to go back to work in two weeks and my DH and I have decided that it would be best for me to be a SAHM.  My job requires a lot of driving around town so pumping would be tricky (I don't feel comfortable pumping in my car if I would be in a bad area of town, which would be pretty often.) Also,  about half my paycheck would go to daycare.  Most importantly, I just don't want to miss my DD's milestones and have someone else raise her. 

If you quit while on maternity leave, did your company make you pay it back?  HR never mentioned anything before I left and I couldn't find anything on the corporate website (Could they enforce a policy that isn't in writing?).  Should I check with HR about the policy before giving notice to my boss? I'm not sure if it would change my decision but money will be tighter once I'm a SAHM.

When's the best time to tell your employer?  Should I give my boss a two weeks notice or wait a little longer?

  • I gave my company an official notice 2 weeks prior to returning, but my supervisor and teammates knew much earlier.  I think the labor laws vary by state.  According to my brief research via google, they can't make you pay back your maternity leave but they can hold you responsible for the insurance premiums they paid on your behalf.  I'd check with your HR department just to be safe.

    that is untrue. Also- this has nothing to do with state labor laws.

  • I did not have to pay back.  I was out on disability insurance after DS was born, so it was insurance I had had for many years, not my employer, though it was through my employer.  I also got paid for some vacation time. 

    I was out on leave for 9 months before I quit, so I was paying my own health insurance (through DH).  

    It is extremely difficult for employers to collect on things like that, so most leave it alone. 

  • I didn't have to pay anything back.  Their written policy is that you may have to pay it back.  I gave notice when my paid disability stopped but my boss and team knew I wasn't coming back before I did!

    Maybe it's not state labor laws, but it does vary by state.  In FL, you do not have to pay back $$ you received from Short Term Disability while on maternity leave.  However, companies have the right to hold you accountable for insurance.

  • I resigned a week before I was set to come back (it was unexpected). I did not have to pay back my STD because I had paid the premiums before the benefit was paid out to me (that was the way HR described it).  I would definitely look in your handbook if you have it to see, it can vary by company and state.

  • I took a 12-week leave from my teaching job, went back for the last 2 weeks of the school year, took a year leave (unpaid) and quit during that year.  I didn't have to pay anything back.
