Would you retain a lawyer?

For a child support hearing?

I don't know my date of my hearing yet, but having a lawyer would really calm me down. I know they base the amount on certain factors and use a standard calculator, but I would really like to have someone there to be my legal advocate. I'll definitly hire someone if my ex decides he wants visitation or wants to petition for custody, but I'm really not sure about child support.

WWYD?

In my professional network I have multiple contacts for lawyers. I wouldn't have an issue finding one who specializes in this sort of thing.

  • Without a doubt - yes.  I know that DB is smooth and really good at making everything look like it is someone else's fault.  I want an attorney there to cut through his BS and focus on the facts.

  • I know that having a lawyer greatly enhances my peace of mind.  My friend was in a similar situation to yours and even though she was told she didn't need a lawyer, she retained one.  I think that it made her feel better and she felt it was worth the extra money.  When it comes to our children, we sometimes need this.  I would do it if I were you.

  • If you can afford it, yes. I could not. I know that after child support is settled he will come after me with a lawyer for visitation/custody and I will need a lawyer then.

My caseworker has made me feel very at ease and that he is working for me. So I do not have a lawyer.

But I would not be suprised if he shows up with a lawyer for our second court date tuesday.

  • I hired a lawyer because I was afraid I wouldn't be able to stand up to XH - he is very good at pleading his own case, and I wanted to make sure I had backup.  We never had a hearing except for our final divorce hearing, and I think part of that is that I had a lawyer the whole way through making sure the girls and I were taken care of.

  • I did not have my lawyer there as it was not necessary - it is purely a calculation based on incomes and insurance and daycare, etc... in fact, STBXH had his pricey attny there with all these "documents" and none of it mattered....he was still ordered to pay 150 more a month than he thought he would owe :)

This.  Except for the actual divorce.  I've done it all myself.  I've been my own advocate for the initial CS and each modification after, every time I've had to go to court b/c DB refused to pay CS.  I've Been the one to write my own letters to the enforcement officer and to My state senator to get things moving again when DB was at his highest arrears balance of close to 15K.

The information is out there to arm yourself with and especially the first one you really have very little to say.  As the modifier said to DB when she set CS, "the numbers don't lie you pay what you owe that's that there is no negociation."
