SB Nesties: Toddler parks and dogs?

I've been seeing an increase of people taking their dogs to the playgrounds at public parks. Usually we just stick to gated toddler areas and it isn't an issue except people are now bringing their dogs into gated toddler areas. 

Today just pushed me over the edge. First, a black lab lunged at another dog in the toddler play area, right next to DD and scared her. She started screaming and crying. The dog owner was nice and took their dog back to their car. 

Then not 5 minutes later (just as I got DD settled down and back on the swings) a lady with one of those dogs that might be classified as a small horse (HUGE dog, no exaggeration) came and parked their dog next to the swing that my daughter was on. My daughter said over and over how much that dog was scaring her. I asked the lady nicely to move her dog because she was scaring my daughter. She said no and mouthed off to me saying it was a public park. It took all my will power to bite my tongue, not take a swing at her and just move my daughter. 

Does anyone know if there are ordinances in San Jose regarding this very issue? It seems like common sense not to bring dogs into a gated play area for toddlers. Do I have any recourse if people scare/threaten my children like this again? 

Sorry, I'm so shaken up , I'm not thinking straight.

  • I would never think to bring my dog into a gated/sectioned off area just for kids. IMO, he should be walking/sniffing, not hanging out next to swings, etc. I think there are ordinances because Campbell Park in Campbell specifically has a sign saying no dogs near their kiddie area.

    Maybe check out sjparks.org?

  • Some do dome don't, however it's realy uncommon for dogs to ever be allowed off leash is a park. The ordinance should be posted at the park.
  • I'm so sorry about your bad park experience!

    There must be some sort of ordinance about dogs in gated play areas. You would think that people would have more common sense than to bring a dog into a gated play area.  I know I would never consider bringing my dog into an area like that.

    Last week there was someone at the park letting their large, unleashed dog run around the playground.  Nobody said anything to the owner, but I know several of the parents were very annoyed.

  • SJ has leash laws, all dogs are required to be on leash in public areas (including front yards) unless they are in a designated gated dog park (or the front yard is gated).

    So if these dogs are off leash they are breaking the law.

    Unfortunately DH and I cannot currently think of any muni codes about dogs in parks in general or in children areas of parks.

    Check around the park and see if there are any signs up about dogs (usually there are only leash signs and doodie pick-up signs though).

    I will pull out my muni code book and see if I can find anything...I'll get back to you via email.

    I checked and couldn't find anything so I left a message with the city. It does say that under no circumstances are ponys allowed. This thing was big enough to be one!

  • They were on leash.. but as we saw today, that doesn't stop dogs from lunging at each other around small children where someone could get hurt. If there are no codes, I'm going to personally make sure that one is going to get passed. Why do people have to lack so much common sense and common decency so much to the extent that there has to be laws for just about everything? Arg!

  • Those people are lucky a child didn't get caught in the cross-fire.  You are a strong woman for holding back like that.  Most people would get all ghetto back at that person and as releasing as that is it still sets a bad example for the kids.  I definitely hope you do find a current law that doesn't allow dogs into gated and designated children's play areas.
