Sorry...another bc question

We are still married and the divorce won't be finalized until after the baby is born. Can I give the baby my last name (I still have my maiden name) or does it have to be his last name?

  • I'm thinking the baby will probably have your STBHX's last name. I'd talk to a lawyer though.

  • You can name your baby anything you like...there is no law that he/she has to have your or your STBX's last name...you can give them any last name you wish...I recommend Bananahammock! I kid but seriously there is no last name law...HTH

  • I concur with pp. You can name your DC anything you want.  Even in the hospital my DDs were known as baby "my maiden name" (I kept my maiden name) but on the birth certificate I put their dad's surname.  I was even asked if I made up the last name because it is very unusual and looks like it could be made up. lol

  • Yup, the baby can have your name. Just write your name on everything and it will be done!
  • I gave Payton my maiden name (which I plan on going back to ASAP) and XH's last name-hyphenated.  I think you can do whatever you want.
