if a used car dealership has to disclose if there is anything wrong with a car before you purchase it or if they only have to tell you if you ask??? does that make sense at all... tia!
it's tricky, are you trying to do a lemon law type deal? Most don't apply to used cars, depending on mileage etc. and even if you ask, it doesnt mean they are going to be truthfull. You should do carfax.com
We bought a used car from a dealership 3 years ago. Drove it off the lot and the next day it stalled in the middle of an exit ramp with a Mac truck behind us. We kept taking it back and telling them to fix it, but they swore there was nothing wrong with it. We took it to another dealership to have it once-overed, and theycame back with $4500 in problems. That dealership told us to consult a lawyer, but we didn't think we had a case. I really regret it. Over the next year, we sank another $2k into the car.
Not matter what answers you get here, call a lawyer. It's worth it.
Disclosure requirements vary by state. In any event, if you specifically ask about problems known and they do not answer truthfully, you could pursue a fraud charge. I know that NC has a strict lemon law, don't know about VA, you'd have to consult an attorney barred in that state.
FYI, carfax isn't that great. If the "accident" or problem was filed thru insurance it probably isn't on a car fax report. Most body shops and machanics don't worry about carfax, unless dealing with insurance and they might have too, because it cost them too much and takes too much time.
