Any Realtors?

A friend of mine is selling her house, she's in contact with someone right now who needs the price a little lower, she cant go lower.  Her realtor contract is up in July, she's thinking of not resigning and doing a For Sale by Owner with him, (so she can lower the price since there wont be realtor fees) for some reason I'm thinking she cant do that without getting in trouble with her old realtor.  Is that right?

  • Is the interested party someone she knows personally, or someone who was made aware of the house through the realtor's efforts?  And those efforts include a sign in the yard, being on the MLS, being shown the house by another realtor, etc.

  • No she doesnt know him, he in another state actually.  She posted about her house on a military site, and he found her there, so not 'through' the realtor, but he might have viewed the realtors listing or something, I just dont want her getting in a sticky situation.

  • Ah.  Well, if she took advantage of the realtor's listing her home on a website, then yes she does owe him/her commission. 

    What your friend is trying to do is pretty shady, and could definitely get her in legal trouble.

  • I agree with pp.  If the realtor had anything to do with the buyer finding the home then the sellers owe commission.  If your friend wants to do FSBO after the listing agreement is up and finds someone on their own no big deal but otherwise shady.

  • yes, she would owe a commission.  I agree with pp's.  That is pretty shady.

  • I am a Realtor, IF the buyer has seen the home and/or the Realtor was procurring cause in ANY way to the sale, then most listing agreements cover the agent for up to 6 months after expiration. If that person approached her the day after the agreement expired, so be it.  She may want to talk to her agent, if the buyer isn't working with anyone and the agent could get both sides, there may be a way to help.  I know when I am getting both sides of deal, I offer more wiggle room, especially since the buyer isn't someone I had been working with for months (that would be a whole different story).

  • I think the rules differ by state, but she can absolutely get in trouble (and be subject to a lawsuit) for doing that in Arizona. I think she would have to wait 90 days or something to make the sale without getting in trouble with her Realtor.

  • Ask the realtor to give up some of her commission to help make up the difference.  In these times, you think a realtor would do just about anything to sell a house, as long as are making some money on the deal.
  • if she met the buyer through her current listing with realtor she owes him/her a commission for I believe 6 months after the contract expired...maybe its a year? I have been out of the business since DD was born but DH is still a realtor.
