"we are not responsible for dropped cones"

so we went for ice cream tonight at a local ice cream parlor.  my husband ordered a two scoop cone and while we were still standing at the counter he took a lick and the ice cream fell off the cone and onto the floor.  there is a big sign in this parlor that says "we are not responsible for dropped cones" so he was going to just pay the $3.50 and not fight for a new cone.  i spoke up and eventually he got a new cone (after speaking to the boss)...does this rule seem unfriendly to you to have in a local ice cream parlor????  or was i being pg crazy??

  • I used to work at an Ice Cream shop many years ago and we would replace things within reason. And your situation definitely sounds within reason. I think that's pretty rude to have it posted. We would never have been allowed to post a sign like that.

  • I think its understandable that they have the sign, because I'm sure tons of parents just hand the cone over to their kids and while they're paying or finishing ordering the kid probably drops it. But in a situation like your DH's I think it's definitely fair to give him a new cone, because if the icecream falls off from a simple lick, it was not well-constructed in the first place.

  • It doesn't sound like the ice cream was properly placed in the cone if it fell off with one lick.  I'm glad your DH got a new one without paying!

    I would think of a dropped cone as someone actually dropping it on the floor, or knocking it off after more than one single lick.  And I don't think they should have to replace a cone that is dropped by a patron - but ice cream that is knocked off by a single lick sounds equivalent to the cone being dropped during hand-off -- ie, should be replaced.
