Update! Wierd facebook message, suing about car accident?

I posted earlier about a message that I got via facebook about a car accident I was in over a year ago.  Apparently my passenger is suing me although I was not at fault for the accident.  My lawyer said that they don't really have a case but even if they do, my old insurance company is footing the bill.  They will appoint me a lawyer and pay all the fees if they do find me 'guilty'.  I'm a little irritated because I talk to his sister on a pretty much daily basis and nothing was ever mentioned to me.  I would have just liked to know that I was getting sued before some random guy facebooks me about it...

  • If FB is the only contact you've seen about it, I'd ignore it. If the passenger wants to go all legal on you, there are more professional ways to do it.

  • I called my lawyer and he had heard about it.  He talked to my insurance company who is apparently the person that emailed me.  I thought it was this guys lawyer.  They seem to have it all taken care of.

  • Weird, obviously the passengers insurance company is going after yours... maybe the passenger feels uncomfortable about telling you?

    Weird you found out on facebook though. That would be irritating!

     I completely agree, it sounds fishy to go a year with no action and now want to sue.

  • I agree that it's probably the passengers ins. company going after yours. I would contact your ins. co but until you get served the papers i wouldnt worry to much about it. Even then don't worry about it...your ins co will handle everything for you.
  • Someone else posted earlier today that they got an email saying pretty much the exact same thing you are reporting.

    Sounds like a scam to me.

  • I've worked in insurance claims for 10 years and (aside from the whole Facebook aspect), nothing about this seems unusual to me. 

    Even if the accident was not your fault (although only a jury can say who is at fault for an accident), the passenger still has to sue you.  If they don't, it opens the door for the other driver to blame you for the accident.  If the jury chooses to believe the other driver and the passenger hasn't sued you, then a jury could find you at fault for the accident and the passenger would not recover any money.

    The statute of limitations in North Carolina for your passenger to file a lawsuit is 3 years from the date of the accident.  Lawsuits aren't typically filed too early because a) the plaintiff (your passenger) needs to complete treatment for his injuries, and b) before the 3 years expires, the passenger and the other party's insurance carrier can discuss a settlement without litigation.  I'm inferring that they did that but were unable to reach an agreement.  The next step is for the passenger to file the lawsuit.

    But, as was explained to you, your insurance carrier is footing the bill for everything.  It will be a bit of a pain for you (you'll probably have to complete some paperwork and maybe give a deposition), but at least you won't have to pay for it.

  • print off the facebook message just to have for your records.  otherwise i wouldn't worry about the case...  but whatever happens good luck!
