is anyone a lawyer--I have a ?

I'm curious as to what constitutes a hostile work environment, and if making someone for their weight when the weight gain is linked to a medical condition is considered discriminatory?. TIA!

  • Hi, I am not a lawyer but I work in HR.  There is no clear cut definition of a "hostile work environment" becuase what makes a hostile work environment for one is not a hostile work environment for another.  Basically when someone feels uncomfortable at work due to someone doing something to them, calling them names, posting obscene posters etc they define what a hostile work environment.  I know it is kind of vague, but it is kind of a grey area.

    What exactly is happening?  Is someone making comments?  Are there any employment actions being taken against someone?

  • what do you do for a living? what are the pros and cons of getting a new job?  it seems like you work for a really crappy place.  why not just find a new job.  i know that is easier said than done, but you have to do something different. 
  • Here's the run-down. I have two bosses, B and then B's boss, K. B and K are constantly making my work life a living hell.

    1. They make jokes between each other and the rest of the office about my weight gain. I gained weight after going on anti-depressants and seizure medicines when I lost our little boy, and they've made me put on a few pounds.

    2. K will send B a project for me, and then B will forward it to me at the end of the day and change the due date to the next day so that I won't have enough time to finish it.

    3. Several random employees have asked me what I ever did to K because she is openly rude to me in front of other people.

    4. B made a joke about my dead baby's urn, and then when I told her how it hurt my feelings, her response was, "Sorry, won't mention it again."

    5. B and K will send emails back and forth that are about how bad they want to get rid of me. Or they will do something to intentionally piss me off, then email each other and talk about how fun it was and how I'm not talking to them. It's amusing to them.

    The whole thing has worked me up so badly over the past couple weeks that I dread coming into work everyday. I feel like they're trying to make me miserable in order to get me to quit. I am scared that they're going to push me to the point where I snap. I get the shakes because I'm afraid I'm going to smack one of them, esp after the "dead baby joke." I just don't know what to do, addressing them about it will only make them target me more.

    Actually, I work doing HR for a Miller Lite Distributor. However, I also have a teaching license, so I'm currently working on getting a teaching position for the upcoming school year. But because I have a child, and DH pays child support for his, I can't have a lapse in employment so I have to stick it out here. But I concur--I work for a crappy place. So does my mom, as a matter of fact, and she actually just had a sit-down with K and said, "You're the HR director, and Torri's afraid to come to work. Knock this bullsh!t off before you push her too far." She said K told her that she knows she has a problem with B, but she's working on it, and she's sorry to hear that I feel like I can't talk to her. How can she be surprised by this? You talk crap about me and leave nasty emails where I have to see them...and you're shocked I can't talk to you? Crazy little troll....
  • I think you need to file a complaint with corporate HR, then they should complete a formal investigation per whatever your company policy states. Make sure you save emails, record dates, take notes, etc. to aid in the investigation. I hope this doesn't sound insensitive - but having your Mom talk to them was probably not a good idea & may serve just to make things worse.

    They said something about your dead baby's URN?  Get a damned lawyer....NOW.  I would.  That's crazy, and insane to think some BOSS somewhere would be so STUPID.  What a complete jackass!

  • I practice family law but I will tell you the following:

    file a complaint with HR

    Keep notes and details, make copies of everything, take it home with you so it can't get "lost" in the office--take note of who heard or saw things

    talk to a lawyer now about what else you need to build your case. 

  • I also practice family law - and concur with septsoulmates: file a complaint. document everything. document everything from others. you could also call whatever state agency that processes discrimination cases (in NY it is the New York Human Rights Division) - they look into discrimination/work environment issues. I think because of your medical related issues there is a case for this to be considered part of disability/health discrimination. You don't need a lawyer to talk to them (they are the lawyers), but you also potentially have remedies on your own, and should consult an employment/labor lawyer.
