So freaking pissed!!!!

I've been dealing with the insurance companies all day in regards to the accident I was in yesterday.  The guy isn't admiting fault and when all is said and done I have to pay my $750 deductible no matter what if I want my car fixed.  So freaking unbelieveable considering the guy didn't even ask me for my insurance.  I'm sitting here crying at work.  Goodbye Christmas!

  • ((((hugs)))  So sorry...that totally sucks.  How bad is the damage?  Since you'll have to pay out-of-pocket anyway, any chance of just postponing having it fixed until well after the holidays?

  • Did your insurance company tell you that you have to pay $750?  Were the police involved or was an accident report completed?  It shouldn't matter if he admits about fault.  The determination should be done by the police or the insurance investigator.

  • If the guys admits fault, you should get your deductible back... eventually.

  • That sucks.  Was it you that had a DH that was really mad that you didn't call the police? 
  • We didn't call the police.  I didn't think there was a need to since the guy gave me his insurance and didn't ask for mine.  I regret not calling.  I told his insurance company what happened, that i was already fully in the middle lane when he pulled in from the right lane to the middle lane.  He said that we both came into the middle lane at the same time.  His insurance company is saying that since it can't be proven who was at fault that they can offer 50% for the damages. 

    I wonder if I call them back and tell them that I'll have my insurance repair the damages if they pay for my deductible they'll accept that over the 50%?

  • Yeah, that sucks that you didn't call the police, they might have aided in blaming the other guy.

    Did you call your insurance company and ask them what to do?  They might not be of help though without a police report.

  • He didn't rear end me, he side swipped the back rear panel above my tire on the passenger side.  I can't believe that neither insurance company is taking into consideration that he never asked me for my insurance.  I think that's basically considering fault if you ask me!

  • The repairs are basically being handled through my insurance.  Since I refused his insurance companies offer to pay for 50% of the damages my insurance company has to pay for 100% of the damages and then they do an investigation to determine who is at fault and if they determine he was then they'll recoup the costs including my deductible.  In the meantime, I still have to pay the $750 deductible.

  • Did you ask his insurance company to do an investigation?  If they do and find him at fault then they will pay 100% plus deductible.  Then you won't even be out that money.

    How do you have to get estimates?  Who will do the repairs?  Sometimes auto body shops will work with you to get back your deductible earlier or allow you to pay it once the claim is settled.

  • Ugh, sorry girl. I always call the police. So sorry you are going through this. People are really dishonest.
  • His insurance company said I need to have my insurance company handle it from here since I refused their 50% offer.  My insurance company will now go forward with an investigation to determine fault.

  • When I was in an accident I called my Insurance Company and they told me that I would have to pay the deductible up front and that they would hash it out with the other insurance company and eventually I would have gotten that money back.  Luckily for me the guy that rear ended me admitted fault.  You can still fill out a police report...
  • I'm so sorry.  I've been in your shoes and it totally sucks.  I was hit last year on the side of my car.  No way it could have been my fault and the other driver lied in what she told the insurance company and she never filed a claim to get her own car fixed.  I was basically told by insurance that they knew she was lying but they couldn't do anything.  I had to pay 20%  of the cost of repairs.

  • I'm writting this to tell everyone to call the police & get a report done by the officer if you are ever in an accident.  I was in one with a semi-truck when I was 8 months preg her did an illegal U-turn & damaged my truck from the gas tank to the lights.  I ended up having to go to the hospital after I left the scene because of contractions they gave me meds to stop them.  I had called the police & he said they did not do a report if someone was not taken to the hospital by ambulance.  I was feeling fine when before I left so I said no.  The other driver admitted fault & then ended up lying & I had to take him to court.  I had to pay to have the police officer there & he testified that the other driver said it was his fault & I still lost the case because there was no police report filed & the judge said I didn't have enough evidance to win the case.  So ALWAYS get a report even if the cop tells you no demand that he write one.  Sorry this happend to you & I don't think you can prove that he was at fault unless you have an eye wittness to the accident.
