CA Working Moms: When to Apply for SDI?

Mobile: CA Working Moms: When to Apply for SDI?

I?m not a working Mom yet, but I will be soon.  I?ve posted on this board a couple of times and found it very helpful.

I am 35 weeks pregnant today.

I will be going on Maternity Leave on 7/19. I will be 38 weeks pregnant. My EDD is 8/1, but due to medical issues, I most likely will not be allowed to carry my pregnancy beyond 39 weeks. And, my job requires me to give an exact leave date, otherwise I would stay until I went into labor.

I live in California and am planning on filing for SDI and then PFL while I am on maternity leave. I read some information on the website, but it was confusing. They say not to file early?but does that mean I have to wait until after I have the baby to file? Or do I just need to file on 7/20?

Also, I will be being paid out 1 week of vacation from 7/20-7/27, so does that mean my claim for SDI should begin on 7/27?

Thanks in advance for any responses!

  • I am in CA as well -

the paperwork that you need for the state is all done online and cannot be done until you actually go out on leave. You can get to it at the website: edd.ca.gov. you can click on the Disability tab and you go to SDI Online to file the claim.

I've had 2 babies in CA and both times my doctor actualy signed and submitted my paperwork for disability.  the PFL just automatically went into effect when my SDI ran out. Just remember to keep your stubs of any checks you receive for disability and be sure to not pay CA income taxes on them (only federal income).

You can't file until your leave has started, so you would file on the first day of your leave. The first week of SDI is unpaid but you can receive vacation from your work from that time. So you can file for the first day of your leave 7/20.

After the baby is born you'll get paperwork from the EDD about the type of birth, etc. to determine if you get 6 weeks or 8 weeks. You return the paperwork and then when that 6 weeks or 8 weeks is up, PFL will start immediately.
