Late Term and Child Loss

So I found out my dr really really screwed us...

He kept telling me not to come in that nothing could be done and assuring me the baby was fine. So he was born at home and I had to pull him out... His mouth was wide open as if he was trying to scream and then he closed it... I didn't realize it at the time bc I was in shock but he was alive. Had he let us go to the hospital he would've been recorded as being alive at birth and would've gotten a birth certificate which he deserved... He didn't... We got a fetal death certificate... He deserved to be recognized for his short life... And on a lesser note he would've been recognized enough to allow us to deduct him...

  • Even though nothing can bring him back now and nothing can really be proven I'm thinking I may actually call a lawyer and see if anything can be done for negligent care and pain and suffering... I came in that morning at 8 with bleeding and all they did was an ultrasound with no pelvic exam or anything and just bc he had a heartbeat they said he was fine... And he kept telling me to stay home afterwards all the times I called.

  • I agree with the previous poster. I tried to get a lawyer involved in my case because my doctors refused to do my c section and my Dd was almost 10lb at 38 wks and wasn't moving a lot. Which was different from the norm then my DD died 2 days later I blame the doctors but I had no case in their eyes DD was fine when I left and they felt no need to do my section earlier than my scheduled day which was just 5 days away. She died 3 days before. My lawyer said there was no case. So please take my advice be easy on yourself. Switch doctors that will help ease your mind. I did and my Rainbow pregnancy was wonderful with my new doctor of course filled with stress but they were so much different with me.

    Our situation was different than yours since Kam was nearly two...But the 911 operator told DH the wrong way to do CPR.  We couldn't sue or do anything about it at all. 

    I am so sorry, I wish that there was anything we could say to make this better.  Huge hugs.

  • Sorry I went away from the board for the better part of the week to try to heal a little. I never called a lawyer but woke up mad again this morning... They just did an ultrasound and since the baby looked ok they did not vaginal check or anything... Apparently it was just very preterm labor and there was a chance they could've done something to halt it... I am not pursueing legal action but they really should've done more. I had a fairly inexperienced midwife checking me and while I do really like her for a lot of things I don't think she knew well enough to look

     Did they check your cervical length when they did your US? If it was long at that time then there is likely nothing that could have been done differently. If it was shortened & they sent you home anyways then I'd at least file a complaint with your state's medical board.

  • They didn't and that's one of the things I've been a little bitter about... The nurse had me strip down but the midwife just saw he was fine on the us and didn't look further.  I keep wondering what if :-/ he wasn't born til 16 hours later soooo there's a chance they could've done something... We are in a small town with limited resources and they have been great after so I hate to complain but I really think they let us down and I could possibly still have our son :-/ It really wasn't too late for a cerclage probably or some type of meds...
