Call it in or not? WWPD

Cause it's slow and this is what I'm dealing with today:

Long story short, saturday night DH & I went out for a friends bday. Before we could even park the car a drunken AHole of All Aholes jumps out in front of the jeep and starts punching, kicking, body checking etc. There is about $1300 worth of damage (DH got an estimate yesterday) We have insurance and for vandalism it's a $100 ded. There was a police report made because the guy did this to 2 or 3 other cars after us and someone else called the cops. Drunken dumbAHole was arrested.

I called the insurance company to make the claim but I didn't have the incident report on me, they said no problem, call back with it. IF I "remember" to call back the insurance company will end up subrogating after this guy (also meaning I get my $100 back) IF I "forget" to call in the report number... The guy will probably just have to deal with drunken disorderly or whatever charges the cops took him on. (Not to mention the other vehicles he damaged) I pay $100 and insurance pays the rest.

On any other day I wouldn't really have a hesitation, of course make the guy pay for it. BUT I feel a very VERY small part in my heart for him because was at a funeral (of whom, I don't know) But was up at the bar drinking all day afterward. Part of me wants to press charges, go to court and just lecture him on what a total TOOL he was.

Re: Call it in or not? WWPD

  • It sounds like he's got a criminal charge regardless of whether you show up or not, so I would definitely get your money from him if you can. Meaning, you're not gonna prevent him from having to plead guilty to the charge, so you might as well get the mon

  • Let him tell it to the judge. Anyone that gets that crazy drunk needs help. Plus, why should you have to foot the $100?

  • I am with mostly everyone else.  Call and get your money.

I also think it is nice of you to give some compassion to the guy, but still, bad things happen all the time and we all still have to act like adults and do the right thing (fo

  • I would call it in. I feel for his loss but it isn't your fault that he dealt with his sadness in a way that hurt others.

Won't the insurance company go after him for the full amount of the damage?  Not just the $100?

  • I think Kiraliz said it best. People need to be held responsible for their shiitty actions. Also your insurance company shouldn't have to pay to fix your car when there is someone obviously responsible that should be paying.

  • You don't need to go to court for the insurance company to subrogate for the damages. Take it from someone who handles auto insurance claims and call to give them the police report number. It's not just your deductible at stake; its the entire cost of rep

  • Call! As a former insurance adjuster, it's not just about your $100 deductible.

The insurance company will go after him for the whole amount of the damage including your deductible. This is what keeps insurance prices down.

  • Yep, I'm going to agree with most of the PPs here and say you should definitely, without a doubt, call it in. I admire your compassion for this guy's situation, but TBH, personal hardship doesn't give him carte blanche to damage someone else's property.
