ETA It may take a while. We got behind when DH and I both lost our jobs in 2009. We were paying half the CS each month, then we couldn't pay any CS when we had he kids with us for the summer. The IRS took the refund the following year, we filed in February but she didn't get it until December for some reason.
I think she would get all of it.

My understanding is that the IRS holds the return for 6 months to allow time for the spouse to file a grievance for their portion.
Oh OK. It was irritating. The tax guy said we could file a form saying she doesn't get my half of the return. I told him not to file the form, she could have the whole thing because we were trying to catch up. He called and said "oops! Filed the form, now it will take longer and she will only get DHs portion." I was so annoyed.
