maternity leave

hey ladies :) congrats- hope everyone is feeling great! i'm due mid january and im alittle confused about nj maternity leave laws. i know i have 4 week prior and 6-8 weeks after (natural) however how far in advance do i need to do the paper work? also is it ok if i work 2 jobs part time for paper work reasons? this whole process is confusing ughh

Re: maternity leave

  • It really depends on your company. I only got 6-8 weeks (6 natural, 8 for c-section) plus the 6 weeks bonding (NJFLI). If I took that 4 weeks ahead of time it would be counted against my FMLA which is only 12 weeks long and ran concurrently with all my time off.

I've heard other companies are better, but it's not unusual for companies to give crappy maternity leaves like mine was!

  • I'm due Dec 16th. NJ does allow for 4 wks before and 6 wks after which can be extended if your Dr. says you need more recovery time. However, FMLA only applies if you work for a company that has more than 50 employees. Because I work for a small company, I'm not eligible for FMLA. You must also have worked for at least 12 months and worked at least 1000 hours during those 12 months. Source: https://www.state.nj.us/treasury/pensions/epbam/additional/fmla-qa.htm

    Good luck!
