Getting out of a ticket....

So, if the trooper puts the wrong color down for your vehicle, can you use that to get out of a speeding ticket?

Yep, Mrs. BB Leadfoot got busted driving over the divide to the pumpkin patch.  I was within eyesight of the exit and he was right behind me, driving a flippin' MOM car!

I don't think it helped that Charlie proudly announced, "MOM.. you were very very speedy!"    HAHAAHAHA

  • Wow, moral dilemma. Those darn tricky police officer!  Can you pleas to a lesser charge, and drop the points?    Too funny about Charlie!

  • Well, if you figure something out, let me know.  A few years ago, I ran to the store to get a bag of carrots.  I got pulled over for going through a red light (I will argue until the day I die that the light was yellow.)   $85 ticket.   I wanted to fight it, but DH said I would never win and should plead guilty to avoid points on my license.  He said that in the end, the fine would be less than the insurance rate increase.

    That ended up being a $400 bag of carrots.

  • Well, unless there's an error on the code he wrote down or something, I'm probably out of luck.

    $162 bucks and 4 points... knocks down to 2 points if I just pay up.   I don't think it's worth it to fight... I was guilty dead to rights.

    I was fine cruising along in the right lane until I came up on a slow-poke and decided to pass him.  The trooper was behind me the whole time and told me I was okay until I decided to kick it into high gear.

    I have been able to get out of that ticket by going to the court and giving them an engineering explantion that there is a 3 second all red rule so everyone clears the intersection, I was stock in the intersection and had to clear it. For once my civil engineering degree paid off for something practical!

    I could have used that back then!  That's exactly what happened to me--it's a very busy intersection and I was already in the middle, waiting to turn left.   What was I supposed to do?  Stay in the middle of the intersection?   I see people do it ALL the time, and yet I get the ticket.   The officer was very tiny, so I think he had a Napoleon complex.

  • I doubt it - I was once in a car accident (I was clearly hit and at no fault) but the police officier writing the report wrote that I was in the right lane when I was in the left and based on where my car was hit, how she wrote it didn't make any sense or was even possible and the lady that hit me still got off almost scott free.  Luckily I have great insurance and I didn';t have to pay and they dealt with a lot and the lady had to pay some but it should have turned out differently.  When I called the police to get it corrected they told me that whatever is written is final and they can't make any changes.  I am assuming your license plate number or driver's license number is also on that ticket.

  • In NY you tend to get a better deal if you go to court in person.  They will generally allow you to plea to a lesser charge (fewer points) and the judge will usually assess a lower fine than you'd get if you just mailed in a guilty.  Not sure if this is true in other states.  NY fines can be really expensive.  Like 400 for a speeding ticket.  The first 90 bucks goes to the state and the rest to the municipality where you got the ticket.

    In all honesty, I'd just call to see about an amended ticket as the code was entered in wrong, but given the circumstances, just pay it and be done with it...
