DH and I have been in the process of moving cross country and just got settled in this past Friday. Anyway, our mail just caught up with us and one is a court document saying that DH is in arrears in CS. Great. So I guess BM is claiming she isn't receiving support again. This is another reason DH wants to have an amount set up with an actual agency instead of an agreed amount between the two of them. Thank god I have all the payment receipts. 

How long does it take usually to set up an order with a child support agency?

So she contacts the court and says he's not paying when he is? Or she calls a lawyer? That's pretty shady.

I've never heard of settling child support on your own.  Thank goodness you've kept all the receipts!  Where I am, child support garnishes my ex's wages and they are sent straight from his employer to the state.  The state then takes out a processing fee and forwards the rest to a debit card for me.

The first and best thing an unmarried father can do is immediately set up CS with the state. Dh paid CS to BM directly for three years and things got bad and she said he never paid a cent. He was in the military so could not come home to fight the case- had to depend on lawyer and boom of course he's $5000+ in arrears. It's so embarrassing and ridiculous. Don't do anything without the state being involved. Yeah you pay 20% in processing but it is so worth it because these relationships go sour just as quickly as they go well. Also depending on your judge a lot of checks and proof of payments can be seen as gifts not CS, just be really careful going that route.
