Single Parents

So I got a phone call at work today..

It was DS's father. It went something like this:

"Uhh...some cop just showed up at my house with a court summons for child support"

Me- "Well, I told you that they would be notifying you soon, but why would a cop have to show up for that?"

"I have no clue, but he started reading the summons to me and then realized that the date had passed (June 25th) and then basically said "oops this date already passed hmm..." and left. So Idk what they are going to do now"

 

Ok, that was some really rough paraphrasing, but you get the point.

#1 what do you think is even going on here?

#2 Do cops show up at peoples houses just to tell them that they have to go to court?

#3 Why the he11 would he not show up till 2 whole days after the supposed court date?

 

I figured I would at least get notified as well. I don't even know who to call to find out what is going on, but we are both confused.

  • In my county in California, you can use the Court (aka the Sheriffs Dept) as a process server...

    But the fact that they missed the court date...that's a fail on them.

  • I think it depends upon the state or county (?) but a civil service worker delivers the papers in person. It's not like they just pop it into the mail and hope it doesn't get lost. A cop is a very likely candidate since I'm sure those type of things can have a negative response.

    Actually, it does depend on where you live, where I am...they mail them.  They only serve them if you don't show up for the meeting. 

  • If I were you, I would contact my local CS office. They were the ones that you went to to start this whole process right? Plus they can figure out a new date and everything, which I'm sure is already being taken care of cause "someone", "somewhere" messed that all up.

  • They served DDs father 10 days before our court date, they had to give 30. Basically, our court date got reset. Here, a process server is used for private suits, and the constable for state suits. 

    My ex was served by the constable because it was thru the AG. I was served by a process server because he went through a private attorney.  

    Yes, they'll show up at your home, school, place of employment, places you frequent...wherever they find you.
