I just wanted to run by the information that I'm receiving past you since I'm hear an ever so slightly different version from the school and the district.
DS#1 went to a state Pre-K in 2010-11. We updated his goals at the end of that year for K on 6/10/11 so that IEP exp. on 6/10/12 (i.e. in 5 days). We decided to do a year of transitional kindergarten for him instead for this year and he attended a private program for the year. Since it was a speech and sensory preschool we didn't feel we should do drive in services as well through the school district. We've now enrolled him in K for the 2012-13 school district.
So the IEP is going to expire before everyone has a chance to meet before the end of the school year. The lady with the district is telling me he will still be legally eligible for services from the beginning of the year. However, the school sounded a bit puzzled about what to do, so I'm wondering if this is really true. Additionally, he is not due to be reevaluated until he turns 8 (turned 6 in May). Honestly, I'm not sure if I want him reevaluated since he's doing REALLY well right now and in general tests well. It's real live classroom that I'm worried about. He's going from a super small setting to a classroom with 24 kids and I honestly have no idea what is going to happen. It could honestly go either way.
In general I like the idea of holding the services that he currently has in place and letting the SLP, special education services and classroom teacher time to get to know him. Under his current IEP he would get all of these and by working from there, I theorize I'll be able to start from a better negotiating position. Thoughts or comments? I am meeting with the principal and IEP coordinator to discuss his teacher placement and to generally discuss him. The county coordinator mentioned meeting with them to also discuss "temporary goals" to use while we are attempting to schedule the formal IEP meeting.
Re: Auntie - IEP ?
In theory, they should do an IEP before June 10th otherwise they are legally out of compliance (and FYI if you had a complaint on day 1 of school and wanted to go due process you would most likely win because of that legality, which is why I'm surprised they'll let it go and do it in August/September). I know school is ending and it's a weird time frame and they don't know him, but, they won't know him that well at the beginning of the year either...they do not have to completely re-test him, informal tests and assessments of him would be just fine...re-evals are more so for the disability label, not the student's strengths and weaknesses. Informal assessments are what make up the present levels in addition to other information and observations. IEPs are not set in stone and you can always call for revisions any time you want. He is going into a different setting and may need more or he may need less. You really probably won't know until a few months in but hey, that's why we have revisions!! Best of luck!
