ugh- just got a preliminary ruling back on one of our motions. The outcome is ok, but we got a new judge for the first time. I hate his style! Our old judge just laid out the decision. This new judge spent most of the document summarizing each of our positions, and then going into his decision. I hate this guy's style! When he summarized our positions, he made several errors and in some areas misrepresented what we argued, and also made several clerical errors (i.e. called me the defendant when I am the plaintiff). Sloppy work. The errors don't change the decision at all, but it's annoying.
Does anyone else have a judge that does this? It just seems so strange- what is the point of summarizing our arguments as part of his decision, especially when he gets it wrong? I wish we still had our old judge... sadly, we have this new one for the next motion too, which is more important. How annoying.
Re: New judge- don't like his style
At least you're able to see where this judge isn't picking up what you're laying down. If he were to come back with a judgement you didn't like, I would assume that would give your lawyer license to point out the misrepresentations and mistakes.
But, yes, still frustrating. BMs lawyer once served DH with a document that had SDs name spelled 3 different ways (none of them correct) within. It's embarassing!
I'd be really concerned about errors being entered on the record. I'm one of those nitpicky English major editor/writer types, so it's fair to say I have a bias here. But that's not something I think I could let go.
Sorry. =(
We had similar issues with our past motion. I think the one that irritated DH the most is that SS was referred to as "daughter" numerous times in the documents but also had "son."
