C's smooshed fingers update

Ok.. so I'm the post whorre lately...

If you'll recall, about 3 weeks ago C stuck his fingers in the hinge part of a big metal door at a KC BBQ place (Jack Stacks) and we had to get x-rays, etc.  Nothing broken, thank goodness.

But the tip of his middle finger, under the nail, is still very bruised and tender.  So I took him in for the pedi to look at it.  Wasn't sure if it was healing properly or not.

Doc says he's actually doing great, but the nail is getting ready to fall off.  Which she says is a very good thing.  The deep tissue bruise needs more room to heal, so it pushes the nail away and a new one appears to already be growing underneath.

To me, this all sounds horrible, but she was very encouraged by it.  But poor boy is gonna have a nasty looking finger for the next several months.  Yay.. just in time for summer and getting dirty.  I will just have to keep it as clean as I can and Neosporin it up if he gets dirt and crap in there.

The funny thing is.. the insurance company for Jack Stacks keeps calling to see if we're making a claim.  I don't think we are since it was an accident.  I told them I haven't seen a bill from our insurance yet to see how much they'll cover.

SO.. if you've gotten this far in the saga... would you file a claim with Jack Stacks???????  I'm sure they'd probably cover the balance of stuff but they'd have to investigate, etc.  Not sure it's worth it.  The ER visit was about $1100 but again, our own insurance should cover most of that.

  • I am glad to hear that he is healing well.   I had something similar happen to one of my toenails when I was younger (I dropped a big, heavy metal stapler on it) and it did the exact same thing and all is well now!

If the accident happened because of LO putting his fingers in the door hinge and not due to any fault of the restauraunt, I would definitley not file a claim with them.  If the restaurant was negligent in any way, then I would.

  • Yeah, it was definite the boy's doing.

Altho I do think the restaurant should cover the seams of the door.. I've seen other places that have a rubber type gasket thingy that goes the length of the seam and prevents pinches like that.  The doors are huge and very very heavy.  We're darn lucky C didn't lose a finger or two.

  • Owie! I'm glad he's doing better but it makes me cringe just thinking about it. Poor C.

Good to read that he will be okay, he will think his finger looks so cool and gross!  He'll have fun with that.  I agree wih pp, you should not file a claim, but you could write a letter to the headquarters recommending they cover up the hinges as you suggested.  If you  verbally suggest it  to the restaurant, they may just ignore it, since you're not going to make a claim.  But writing it the headquarters might bring some attention to the situation.

  • I would only file a claim if the restaurant was at fault and it sounds like (didn't read the original post) that your child put his finger in the door so no fault of the restaurants.  Now if the door was broken or something along those lines, then maybe but kids put fingers in places like the door a lot - happened to a co-workers son years ago when he came to visit at work - it just happens, no fault of anyones but the childs who doesn't know any better.

yeah, not thinking I'd file a claim at this point.  And I had a nail fall off from a smashed finger incident as a kid and you couldn't tell which one it was today.  Hope he gets better soon!

  • GLad he is doing better!

I think you should make your own honest judgement whether to file a claim or not.
