Is a far distance in-state considered a diff state?

I was talking to a friend the other day who lives in Utah and he mentioned that in his state (I live in Illinois) if the parents live over 1.5 hrs or 2 hrs apart from each other it is considered to be a different state. I'm not sure I'm wording that correctly but the reason that came up was because my LO's father moved 2.5 hours away from me but still lives in Illlinois and I was expressing concern about him wanting our baby to travel that distance all the time.

Has anybody else heard this or know about this?

  • I think what you want to look up is what qualifies for long distance custody/visitation guidelines.

  • Agreed with PP. In my paperwork we have it listed as a mileage instead of different state.

    This. In Texas, which is a really freaking big state, it goes by mileage. Anything over 100 miles is considered LD, and changes the scope of the Standard Posession order. 

  • In IL, as long as you're still in the state of IL, nothing will be different. 

    However because he was the one to move away, I'd try to make him do all of the travelling to pick up and drop of LO.  But in all reality, 2.5 hours isn't a whole lot.  A judge isn't going to take away his visitation because of it.
