Please help me understand what this means

In reference to custody in my state, this is at the top of the list of guidelines:

The court considers the following factors:

? any time when the child was under the care of someone other than a parent, and those particular circumstances;

What exactly does that mean?

My mom watches both my girls at my house while we're at work. They're 3 and almost 2.

    I would see your situation more like child care/baby sitting.

    I think it means if you were not able to take care of your child because you abandoned them of you decided to go on vacation for weeks or something like that.

    I was told by my lawyer that even though my mom took care of DD while I was at work, I was still considered the primary care giver.

    So it doesn't really change much of anything? Does it give me some sort of advantage in a (potential) custody battle over the dad?

    This. If anything, it might give you a slight edge. In my state at least, it's considered a good thing when you have family watching your LOs when you work, instead of a daycare.

    Thanks!

    I actually used that in court and it help up pretty well.

    What effect did it have in court? Does it mean if for some reason you're not around, then that 3rd party (my mother, in this case) has some rights?
