Do you have to go to court?

What if you and your ex come up with your own visitation schedule and completely agree on splitting of assets? Do you have go to court, or just have a judge sign off on the agreements?

  • It totally depends on your jurisdiction. I live in Colorado. My X and I were able to agree to things without going to court. We filed a parenting plan and divided all assets. Then we submitted our paperwork to the court and got it finalized. We never went before a judge. That's not the case in all states though.

  • Like the PP said, I think it would depend on where you are. I know that the X and I didn't have to. We were able to decide with our lawyers, have the stipulation submitted and signed.
