Not Using his Visitation

so my STBXH can visit LO every other weekend, but he has yet to do so. I'm wondering if he continues to not show up, can I take away these weekends from him? Right now, him visiting every other weekend is calculated into the child support.

I live in CA and will ask my lawyer but just wondering if you ladies know anything about it.

    It (usually) has to remain in the schedule that he *can* take LO EOW. That doesn't necessarily mean that he *has* to do so.

    I have sole legal and physical custody, but our agreement says BD can visit "as the parents agree".  Since he has no set days when he actually sees him, he gets no visitation credit calculated into CS.  So he can still have visitation with DS if he chooses, but he gets no CS credit for it (which is good, because he doesn't take any visitation).

    Something like this may be better for you if your STBXH is not consistent in visiting.
