Nope. Size doesn't matter *that* much. It's a maturity thing, and most kids that age aren't ready. (says the Mom whose 5 y/o is still harnessed in her Britax Marathon )

If you feel confident that she'll stay buckled, not slouch, not reach to get toys or books or anything, sit up while sleeping and not put the shoulder belt behind her back there's no reason to keep her harnessed necessarily. But, I wouldn't go from a harnessed seat to a backless booster no matter what age and size. The high back booster is important to help them learn how to ride safely in a booster seat.
No. That's the size of my 5yo, and I wouldn't put her in a backless booster. I don't think the seatbelt would hit her shoulder in the right place, plus I like the protection of the headwings in the high back booster.

DD is almost 6 and we just switched her to backless. She rode in a backless one day a few months ago, I can't remember why, but she commented on how much more comfortable it was for her legs. She showed me and I could see how she could sit back further on it and her legs don't dangle as much. So we switched her a few months ago.
We switched her to a high back booster when she hit 40 lbs, which was right after she turned 5.
