In our agreement it states that IF ex comes EO weekend for 3 consecutive months starting in January he would get 2 overnights a month starting on Saturday and ending on Sunday. WELL, He came 2x in October, never in November, and he cancelled this weekend (says he has no money), and plans for come Christmas. It was laid out this way so that ex and DS could bond since he's never here and wanted overnights off the bat.
The temporary order doesn't state what happens if he doesn't comply. Now I know that Ex will be planning his visits for January soon I want to tell him that until he comes for 3 consecutive months he wont get overnights. It's in the order but not specified. He just sent me a message asking for a copy of the CO, so I know he's wondering what happens now.
Is that what you would do? If its not, what would you do? He begged and begged for visitation and now that he has it, he can't show up for it. I am so annoyed. For all the Newbs - My ex is unemployed and lives in FL.

since your order doesn't state what happens if he doesn't comply, i'd let him know that he didn't meet the conditions of the order so there will be no overnights in January (but he can still come for his EOW.) once he does 3 consecutive months of EOW then tell him that you'd be more than happy to do the overnights. in my opinion everytime he misses a weekend, i'd start the clock over. that's what consecutive means (continuous & unbroken)
but i don't think you'd be in contempt or anything if you don't let LO go with him overnight in January (if that's what you were wondering)
I'd tell him that he didn't do what he needed to in order to get LO overnight. Tell him to read the CO again and then plan his visits accordingly.
If the visits are for bonding before the overnights begin, he's done a bad job at bonding since he hasn't come since October (if I'm reading right...). I wouldn't send my child overnight in that situation.
