Divorce help.

I'm sorry if you guys are bombarded by these questions all the time but I need some serious advice. 

XH and I got married too young, had a kid and now we can't stand each other. He lives in another state, is prior military and is probably going to jail soon (I pick them good right?). He has the copy of divorce papers but will not sign them.  We tried to do the route of agreeing on everything and just filing them so we won't have to go to court but since he has been sitting on these papers for months now, it's becoming clear that I might need to get a lawyer. 

Do you guys have any advice on how I can get him to sign them and send them to me? I've tried being civil with him but he has the mentality and maturity of a 10 year old. Also, I'm broke as shiz so getting a lawyer won't be easy for me but if it's what I need to do then I'll do it. Thanks guys.

  • You may have to just bite the bullet and go through and attorney.  I don't know about FL, but in my state you can get a divorce by default if he doesn't to file and answer to the paperwork that you file.  You have to draw up the paperwork, get him served with it and then wait for a court date or his answer to your paperwork.

    This.  You can get one by default in most states.  Before finding an attorney, check with any law schools in your area and see if they offer any free clinics.  Most do (although not aways in family law).  If they don't have any clinics see if there are any legal aid projects or lawyer referral services in your area/state.  Be sure the referral service is run by/affiliated with either the state Bar association or a local bar association.  It should be free and they should offer services on a sliding scale based on your ability to pay.  I don't know about FL but Texas has a couple of these.  You can also contact legal groups to see if they offer pro bono services.  A lot of big firms have pro bono requirements so you may be able to get help for free.  (FWIW, both DH and I are attorneys and have done stuff w/ diff pro bono organizations in our area, that's how I know all this.  I stumbled onto the wrong board but figured I could probably be helpful with this question, hence my post).  Best of luck.

    Actually, we agreed on all points, had a paralegal group do the paperwork for less than $150 and the Divorce judge actually complimented us on how well it was prepared. We didn't use a lawyer or a mediation group.  I did meet with a lawyer to confirm I was doing everything correctly based on what we had agreed to. I did the free consultation. Which, OP, you should be doing. Most lawyers will do an hour or a half an hour as a free consultation. You can get a ton of information that way. A google search states you can get divorced by default in FL.

    BUT I am not a lawyer and google searches aren't lawyer advice.
