So confused about STD and FMLA, help!

I put in for my STD today. And there is one question I can't seem to get answered.

I have to use 5 days of PTO before my STD kicks in, I get 6 weeks if I have a vaginal delivery 8 for a C-section.

My question is, are those 5 days of PTO included in the 6 weeks of STD? My HR department sucks and can't seem to answer me.

Anyone know the answer?

  • My company is the same.  You don't get paid for the first week - so if you want a paycheck you have to use PTO.  After that STD will pay you for 6-8 weeks depending on your type of delivery.  So if you use your 5 days of PTO - then you'll get 7-9 weeks on a paycheck.  Unfortunately my company only pays 60% for STD for 6-8 weeks.  DH's company pays 100% for 12 weeks!

  • typically those days are included - it's a waiting period set by the company who controls your STD policy.  So your 6 week STD is actually 5 paid by your disability policy and 1 paid through your PTO.

If you want a definite answer, the best thing you can do is call the company in charge of your policy

Ditto--I'm an HR Manager for a large public company, and this is how ours works. The first week is an "elimination period" where we require PTO use, and then the benefits would be paid week two onward. Typical approval is 6 weeks for vaginal delivery (1 week PTO and 5 weeks of paid benefits) and 8 weeks for c-section (1 week PTO and 7 weeks of paid benefits). You can also ask for the policy in writing--if there is an HR department, there should be a documented policy.

  • OOPS - looks like I'm wrong and that it is included.  I can't remember what happened with DD anymore!  I would just check with your HR person to make sure.

  • I called the company that is in charge of STD and they haven't gotten back to me and I have the policy in writing but it contradicts itself. I have worked for many places and this is the worst HR I have ever experienced. Thanks!
