My friend just has a RCS and was told it could not be scheduled any earlier than 39 weeks. She wound up having it at 38 weeks because she went into labor though.
My hospital does not allowed you to schedule inductions or c-sections prior to 39 weeks unless there is a medical reason.

My OB/hospital has a policy of no scheduled inductions/c/s prior to 39 weeks without a documented medical reason and an amnio. I've been going almost weekly to an opthomalogist to monitor the pressure and edema in my eyes to avoid a repeat of my last baby (retinal detachment). At the first sign that something is going south they are going to deliver the baby, but I'm scheduled to deliver otherwise at 39 weeks, 3 days.
My hospital and doctors will not do it until you turn 39 weeks. We get to pick the day during my 39th week to have the c/s and last time we got to schedule it at 28wks.
My OB practice will not do it before 39 weeks, which is fine with me - DD was a late baby so I doubt I'd go into labor before then. Mine is scheduled for 39w2d.

DD #1 passed away in January 2011 at 14 days old due to congenital heart disease
DD#2 lost in January 2012 at 23 weeks due to anhydramnios caused by a placental abruption
My OB won't schedule a c/s until 39 weeks unless there is a medical reason to do so. DD was born 11 days early, but I think we'll still schedule for 39 weeks and then play it by ear. With DD, my water broke (at work) and there was obviously no waiting after that.

My hospital doesn't allow for earlier than 39w except for medical reasons. Mine was scheduled at 38w1d because of my classical incision from my first c/s.
i was scheduled for 39 weeks and 1 day but my BP went up and i had protein in my urine at my week 37 appt. so i was sent to L&D for monitoring and while i was there i went into labor--he was born 37 weeks and 5 days.

I'm pretty sure it's now a law that you cannot have a scheduled c-section sooner than 39 weeks, unless medically necessary. I believe it's a new-ish thing.
Unless there is a medical reason that they need to get the baby out early, most hospitals/doctors won't schedule it until you are 39 weeks to make sure the lungs are fully developed.
